Carson Pittsburgh, Pa. 15203. Book prompts reader's desire to retire By Robert Bruw THbune Media Services Retirement is a time of life most people either look forward to or dread. But after reading this book, retirement becomes an anticipated event. The only problem, as the authors explain, is which of the best retirement communities to choose.

Retiree authors Alice and Fred Lee admit they don't live in any of the retirement communities they inspected. (They reside in Richardson, Texas). However, they confide they are considering moving to one, but they won't say which one. This book is a quick, easy read for those considering moving to a retirement community. But the authors cau- Book review The 50 Best Retirement Communities in America," by Alice and Fred Lee (St.

Mania's Press, New York), 1994, 271 pages, $14.95, available in stock or by special order at beat bookstores and public libraries. tion to carefully inspect several before deciding. Their 50 choices are in 19 states, ranging from Minnesota to Texas and Massachusetts to California. The Lees said they inspected many more but rejected some quickly after driving through the gates. Although most of the recommend- ed retirement communities are in warm climates, such as Arizona, Florida, Nevada and California, surprisingly, their most innovative discovery is Edina Park Plaza in Minnesota.

Price and size range from economy to luxury and more than 5,000 residents to just a few hundred. Ufecare communities also are included. Whether you read this book for your own use or buy it as a gift for your parents or other seniors, it is an excellent starting place in the search for the right place to retire. If the book has one flaw, it is too positive and upbeat, because all the comments from retirees at the various communities are enthusiastic. On my scale of one to 10, this book rates a 10.

Delay overrides statute of limitations By Robert Brass Tribune Media Services In 1987, John paid $590,000 for vacant land he planned to develop. At the same time, he purchased a title insurance policy from Chicago Titw? Company. It showed no encumbrances on the property. Two years later, John found a buyer willing to pay for his But when Chicago Title prepared'a preliminary title report for the buyer, John learned his land is burdened by a flood control district easement, which prevents access to his land. John's 1987 title policy from Chicago Title failed to disclose this easement, making his land useless except for agricultural purposes.

On Nov. 8,1989, John filed a notice of his tide policy claim. But Chicago Title was unsuccessful in gaining access to the property for John over the easement area. Chicago Title wrote John on Nov.16,1990, denying any liability for its negligent failure to disclose the 1930 easement when John bought the land. In 1991, John sued Chicago his title insurance contract, breaches of thelJovenariST of good faith and fair dealing based on unreasonable delays and unfair manipulations processing his title claim, and for failure to indemnify him for his loss due to the easement In hs answer, Chicago Title alleged as ha defense the statute of limitations had run.

But John argued the statute of limitations should be tolled while Chicago Title investigated his claim. If jfou were the judge, would you rule John's claim against Chicago Title is barred by the statute of limitations? The statute of limitations on a tide insurance policy claim starts running when the title loss is discovered, the judge began. By the time John filed his lawsuit, the judge explained, the statute of limitations had run and would bar this lawsuit Due to Chicago Title's long investigation period, the statute of limitations should be tolled during that time, the judge emphasized. Otherwise, title insurers will stall claims decisions and insureds will be forced to sue their title insurers before knowing whether the claim wfll be paid or denied, he added. The statute of limitations is therefore tolled for the one year Chicago he may now proceed with his lawsuit to prove the insurer should pay his loss due to their negligence in failing to disclose the 1930 recorded easement the judge ruled.
