He is scheduled to appear May 6 in Allegheny County Cqurt for a orma Rape trial to continue next month By Ramesh Santanam Staff writer PITTSBURGH: The trial of a former West Deer man accused of repeatedly raping a teen-age friend of the family continue next month while the judge decides whether to allow psychiatric evidence. David Andrew Krysik, 22, faces four counts each of aggravated indecent assault and indecent assault, three counts each of rape and statutory rape, two counts corruption of minors and one count of involuntary deviate sexual intercourse. But his attorney, Gary Zimmerman, told Allegheny County Judge Kathleen Durkin that tests at the Western Psychiatric Institute showed Krysik had an IQ of 81, the mental capacity of an average 12- or 13-year-qJd. But Assistant District Attorney Christopher Connors argued such evidence is inadmissible unless Krysik pleads guilty but mentally ffl.

Krysik, who claims the sex was consensual said he wfll not do that Zimmerman is to submit his ment in writing to Durkin by Wednesday, and Connors has until the end of the month to respond. Durkin likely mil make a decision soon after. The nonjury trial will resume May 5. On Thursday, the victim, now 15, said the alleged assaults began in December 1994 and lasted through February 1996. Most of them occurred in Krysik's former West Deer home along School Street The first incident happened when she was watching television with Krysik.

Between then and September 1995, Krysik molested her on a few occasions and taped her one night in his bedroom, vjhere she was sleeping because-Krysik, his wife and some friends were sleeping downstairs, the victim said. Krysik raped her a third time in February 1996 at the home of a friend of Krysik, she said. "I was crying really hard," she said. "He asked me what was wrong, why I was crying." That proved Krysik didn't under- standjhat have stopoed when the victim asked him to, Zimmerman told the judge, "You have to teD a 12-year-old more than one time not to do that," he said. "He understands the consequences of his actions as a 12- or would.

In essence, we have a IJ-year- old girl and a 13-year-old boy." HEAR BETTER! Carol B.
