Schna der had been consulted. The letter was dated February 24, 1934 from New York where Pinchot was re cuperating from an attack of shingles.

Opposed Cheap Whisky In one of the conferences with Stahlnecker and Schnader, the attorney general opposed stocking "Sweepstakes" in the stores, Gawthrop said. "But we went ahead anyhow be cause we thought the stores should have a cheap grade of liquor," the board chairman added. Gawthrop told the wmmittee he had "heard" of "gentlemen's agreements" with distillers for payment of the State floor tax but said he never knew they actually existed. Governor George H. Earle or dered the liquor investigation charg ing "secret contracts" with distillers had resulted in high retail prices and prevent the State stores sy tem from yielding sufficient profits for unemployment relief, old age pensions and payments to the blind Details Sought Gawthrop and Harry Bar.zhoff, secretary of the board, were in structed to prepare additional de tails of the status of one contract in which the Joseph Finch distilling company agreed to sell the State 2,000,000 gallons of liquor during 1934 and to pay the $2 a gallon floor tax after the purchases were complet3d.

Gawthrop testified that about 813,000 gallons of the contracted amount was delivered to the stores by the Finch company during 1934. Large Purchases In contracts with subsidiaries of the Schenley Distilling Company and the National Distilling Corpora tion, the State agreed to purchase 6,000,000 gallons of liquor, including that from the latter company dur ing 1934. This involved $13,000,000 in floor taxes. William S. Gray, counsel for the investigation committee, introduced a letter from Joseph F.

Finch Com pany to the State Revenue Depart ment in which the company pointed out it retained the right to test the constitutionality of the floor tax if the State failed to abide by a previous agreement to purchase all the liquor involved. "I never heard of the letter," Gawthrop said. "I thought that under our previous agreement the company was bound strictly to pay the tax on the entire amount of liquor in the stocks at the time the floor tax act was passed." Losing Proposition In reply to a question from Gray, the chairman said the liquor board "probably" could have bought the liquor cheeper, and, consequently, sold it cheaper, if the State had prosecuted the floor tax suits and lost them. Attorney Gray charged the State, RALPH LLOYD Hershey, Feb. 19.

Should the conference tomorrow fail to end the disagreement, Rose crans indicated he would side with Reilly against Fisher and Pope in the belief that appeal action should not be taken hastily. He deplored the controversy among counsel "when a man's life is at stake," adding: "All of us are in it and nobody can get out now." Partial Agreement Pope, meanwhile, declared that "counsel have got to stop this quarreling." After a conference at the state prison attended by Fisher, Rosecrans, a representative of Reilly, and Mrs. Hauptmann, Pope said a tentative agreement had been reached to continue the as SOCiation of counsel until the ap one hundred and forty (140) feet to the peiiate action is ended.
