City Treasurer, MINE CAVE IN LAW WILL BE DECIDED The constitutionality of the new law which makes land owners liable for surface damages resulting from mine cave ins is being attacked by injunction proceedings filed in Dauphin County court. The action seeks to restrain the State Highway Department from imposing penalties for failure to restore a highway which crosses land leased by the Harleigh Brook wood Coal Company at Gilbertson, Schuylkill county. It is brought by the owners of the land, Clayton Cr.

Dixon, John Gilbert and W. pan MaoCov. trustee, who claim that the damage resulted from mine operations of sixty years ago. The law requires that land own ers must provide for restoration of vertical and lateral supports and replacement of the surface in the case of subsidences of roadbeds, or be subject to a penalty of $500 fine cr six months imprisonment. The netitioners say that they were not responsible for the subsidence which was repaired at a cost of S159L50, and that it is physically impossible to follow the requirement to the letter.

1938 C0URTCALENDAR BEARS SLIGHT CHANGE Copies of the Dauphin County court calendar for 1938 released today, show a number of slight changes, most outstanding of which is a separate and detailed schedule for the newly created Orphans' Court. Other changes re late to dates for specific court ses' sions which were changed by re solutions adopted from time to time during the past year. The new calendar bears the name of Judge elect Karl E. Richards, as President Judge of the Orphans Court, and likewise the names of Leo R. Poorman and Park H.

Fegley, as prothonotary and clerk of courts respectively. FIRE DAMAGE SLIGHT A chimney fire in a double dwelling in Bailey street caused trifling damage this afternoon. Assistant Fire Chief Gilbert U. Rupp, who responded with Mt. Pleasant firemen, said the fire was started by paper burned in the furnace of the John Gontz home, 1199 Bailey street.

The Rev. Dr. S. Windfield Herman The Rev. Dr.

S. Winfield Herman, pastor of Zion Lutheran Church and prominent in the affairs of the United Lutheran Church, today is celebrating a birthday. Completing his thirty fifth year as Zion pastor, Dr. Herman ha" long been active with civil an church organizations; was president of the Foreign Mission Board of the United Lutheran Church; president of the East Pennsylvania Synod, the largest synod of the General Synod of the church; chaplain of the Masonic Grand Lodge of Pennsylvania. A native of York, Dr.

Herman was graduated from Gettysburg College in 1899 and Gettysburg Lutheran Seminary in 1902. D. 2. 'Fornwalt reported Mr. Etter apparently became confused while crossing the street and walked into the side of the machine, striking his head on a door handle. Returning From Polls Members of Mr.

Etter's family said he was returning home from the polls of the Second Precinct of the Eleventh Ward after listening to election returns when the accident occurred. Mr. Etter was the son of the late Calvin Etter and Helen Marshall and was one of the pioneer business men of the city. The grocery and feed business was established in 1865 by his father and for many years was locatpH at Cowden and State streets. The store was moved to its present location when the Capitol Park extension was authorized.

He is survived by two sisters, Mrs. H. S. Kelley, of the Second street address; Mrs. E.

G. Sheaf er, Middleboro, and two nieces, Mrs. G. Vance Seidel and Mrs. Henry Fink, Harrisburg.
