Friends may' call at the funeral home Sunday 3-7 p.m. By FRED LAWSON Metropolitan Sufi Writer Win Cwntv turam LEBANON The Warren County grand jury declined Thursday to indict a Franklin-area man charged with aggravated vehicular homicide after officials said his pickup truck struck and killed a Springboro policeman who was "completely in the roadway" at the time he was struck last month. The same day, the Ohio Highway Patrol charged the man, Michael L.

Jennings, 32, of 3624 Knollbrook Drive in the Hunter area, with driving while Intoxicated in connection with the incident, a patrol spokesman said. Killed in the June 27 accident was William L. "Bill" Johnson. A NOT GUILTY PLEA to the" charge was filed for Jennings in Warren County Court Thursday afternoon by his attorney, David Chicarelll. A pre-trial hearing will be scheduled for Jennings, who is free on his own recognizance, according to a court spokeswoman.

Johnson, 48, an eight-year veteran with the Springboro police, died a short time after he was struck by a pickup truck that investigators said was driven by Jennings as Johnson stood outside hie parked cruiser on Ohio 73, near the police station, at about 12:30 a.m. ALTHOUGH HE DECLINED to speculate on what entered into the grand jurors' decision, Flannery acknowledged that Johnson was "completely in the roadway" at the time he was struck. Johnson had stopped to investigate two persons walking along the road, investigators said. The truck struck the rear of the cruiser and then hit Johnson, knocking him over the hood of the cruiser into the roadway, according to the investigative report. He died a short time later at Sycamore Medical Center in Miamlsburg.

The cruiser's tail lights and headlights were on, but the emergency flashing lights were not, according to investigative reports. There is speculation the fact the flashing lights were not on was a factor in the grand jury's vote not to indict. However, grand jury votes are secret to all but the jurors and the reason for the decision is not known, according to Springboro police Sgt. C.E. Reedy said afterwards, his department has no set policy regarding the use of flashing lights when an officer has stopped to talk to someone.

He said the decision is the officer's. FLANNERY SAID HE explained to the grand jury that, according to law, they could return indictments of involuntary manslaughter, aggravated vehicular or vehicular homicide. He said Patrol Sgt. R.N. Grooms, the investigating officer, testified before the grand jury, as did three witnesses to the accident.

"It's the police's duty to investigate and my office's duty to present the evidence to the grand jury," Flannery said. "The grand jury decides whether or not to indict." Lt. Lewis of the Patrol said he was "not happy" with the grand Jury action and Springboro Village Manager Bill Covell said he was "surprised." "I thought we had a real good case," Lewis said. He said he has "no idea" of the reason for the jury's vote. "I read the investigative report and I am surprised there was not an indictment," Covell said.

I should have known better. My own father, age 81, was in danger of dying of hypothermia, and I overlooked it. He lives alone. When he would come to visit during the late fall and winter months I noticed a difference in his personality. He seemed depressed.

His speech was slow and slurred. He seemed more confused than he used to be. Without examining him, I came up with the hunch-diagnosis of "beginning senility." But one cold day, while visiting him at his apartment, it was quite evident that bis environment was too cold for a man his age. He had the thermostat turned down to the 60s "to save on electricity." I brought him home. I examined him and found that his temperature was 95 Fahrenheit.

His heart was Irregular and he was more confused than ever. I admitted him to the hospital where we "rewarmed" him. Within a few days his mind became clear, his pulse normal, and his temperature up to 98. From then on I've been carefully monitoring him. He now keeps his apartment warm and dresses well.

I say again, I admit that I overlooked the diagnosis in my own father. I note that you've bad several columns' on hypothermia In the aged. I hope you reprint this as an added warning. It's a common and dangerous occurence. Thank you.

MD. I appreciate your letter. Your own experience with your father's overlooked hypothermia will alert readers to the danger in caring for their own parents. Cold is the silent enemy of the aged. Too many are misdiagnosed as being senile.

He was born In Columbus, OH. and was a graduate of Ohio State University and the Ohio State Medical School with post graduate work at the Sorbonne after WWI, In which he served in the Medical Corp. Further post graduate work was at Harvard Medical School. He was a member of the Montgomery County Medical Society, the Ohio State Medical Society, the American Medical Association and was recently honored for 50 years of service in American Medicine. A former Chief of Staff at Good Samaritan Hospital in 1947, he was honored recently for ouststandlng contributions to the medical leadership of the hospital and health center.

Dr. Lewis is survived by his wife, Elizabeth 4 daughters, Mrs. James W. Priest and Mrs. C.L.

BRIAN WARFORD, 17, died Aug. 29, 1981 Spisak said he went downtown looking for someone black to shoot. He said he saw a young black sitting on a bench In a Regional Transit Authority bus shelter. Under questioning of defense attorney Thomas Shaughnessy, Spisak said he parked In a university parking lot and approached his target. He said that about five Laverne, left him, he dressed like a woman.

"THERE'S NOT much was pretty confused back Spisak said. "I'm OK now. I got my mind straigni' ened out and I can think clearly now." The first campus killing occurred Feb. 1, 1982. Spisak has testified that Horace Rlckerson, a black pastor.
