6 DAILY HERALD. CRIMINAL LIBEL. Thornton, Stephens and Wells Examined. A. CROWDED COURTROOM.

Interesting: Testimony Elicited at the First Session of a Sensational Case. The examination of tbe charge of criminal libel preferred by Charles A. Ball against Messrs. A. M.

Thornton, G. Wiley Wells and B. A. 6tephens was commenced before nstice Taney and a crowded courtroom yesterday morning. This oase promises to become quite interesting before it has been concluded, and the attention of many of the oitiaeas has been directed to it by curiosity and by a knowledge of the parties connected with it.

The first witness called was Charles A. Ball, son of Major Horace Bell. He testified tbat he knew all of the defendants. At this point the District Attorney tbe attention of witness to tbe sentence oontained in the complaint: violent was his treatment of wife that it was necessary to confine bar in the Stockton Insane Asylum," and producing tho pamphlet estentitled "Life of Horace Bell" asked bim if he ever saw it before. Witness stated tbat he had.

He first it on the oorner of Spring and Court streets on February 23d, in the hands of P. M. Daroy, a former DaiiUty Sheriff of this county. The contained in the paragraph referred to were nntrue. Witness did net see the pamphlets distributed, nor did he see them in the possession of either of the defendauts.

He one in tbe possession of E. J. King, aud one in the hands of D. Kerane. Tbe attorney for the defendants here moved that all witnesses be excluded (rom the courtroom, and to prevent Major Bell from leaving, the District Attorney entered him as an attorney in tbe case.

Witness continuing, stated that at the time he saw the pamphlet first, defendants Wells and Thornton were about fifty feet away, and they bad papers in their bands. He remembered his mother distinctly from 1868, and never knew her to be insane. He was at no time absent from her for more than six months, and then only twice, but during thote occasions he had visited her frequently. His mother had been away from borne once for a little over two mouths. Objections being made, by the defendants' attorney to testimony being offered going to prove tbe falsity of the libel, quite an argument followed, but the objections were overruled.

Witness stated tbat the demeanor of his father was always kind toward bis mother, and their family relations had always been harmonious. His mother had never been in Stockton. The pamphlet was offered in evidence, as a whole, by the prosecution at tbis point. Cross-examined said he had lived at home during all tbe time since 1868, except for the past two years. Never knew his mother to be insane; -hnew his mother had been taken away, but it was not for insanity.

Never bad heard that Will Widney went away with titer. She went in 1870 to Alameda. Staid there two months. His father took her np there. His recollections of her going up there were clear.

His father returned before she did. Received letters from her postmarked Oakland. Received a letter onoe a week. She was at Br. Tra ir's house, or hotpital.

Did not know who accompanied her back. A nurse and Dr. Widney were at the house when she left. His mother had been ill ever since the time of his brother's birth, about a mouth before she went away. Part of tbe time she was np, and part of tbe time she was in bed.

The home was kept up sbe was away. She had never been ill at any time prior to the birth of his brother. Some of that time his mother was out of her head with a fever, because Dr. J. P.

Widney was trying to roison ber, and "he would have done it if I had not been there." Do not remember whether his mother had discharged him, bnt thought his father had. His mother protested against taking Dr. idney's treatment, and after he told his father about it, he did not insist ou her taking it. He insisted before and that was all the trouble there was between them. Witness had asked what the medicine waa and they had told him it was poison.

He knew now what it was. Colonel Marshall had told him. It was morphine. No other physician had been in attendance. Dr.

Widaey's brother frequently came to the house. Did not remember that Will Widney went away with my mother. She was just sent away for treatment. She was not able to help herself. She had to be assisted, CAPTAIN K.

WALK Kit. The next witness was Captain J. F. Walker, who testified that be had seen a pamphlet resembling that offered in evidence, but he had not read it. Tried to set one.

Tried to get oue from Q. Wiley Weils, who said be had none, bnt was going to have 5000 more printed and distribute them all over the country. Said he had some, but had given them all out. Witness knew that the relations between Thornton and Bell were unfriendly. Cross-examined.

the conversation with Wells in the Encampment room in this city. Bell was not then a candidate for any office, that I know of. Was present when Bell asked an investigation about pamphlet. It was after tbat I had had tbe conversation with Wells and before the committee reported. It was not on that account that I wanted the pamphlet, but as a matter of curiosity.

Wells said he was going to have 5000 more of them printed. He said, "call on me then and get one." AFTHINOON SESSION W.Cobler testified that he knew A. Stephens. He had en pages serei and fourteen of tbe pamphlet. had instructed him to set up a tile pagi in the office of the Progress in Pomona.

Did not set the pagi up but be read tin proofs of them, which were in another printing office. Mr. Stephens said he had a book which he wanted printed, bat witness did not know what that book was about. Witness upon being shown tbe pamphlet stated tbat it was published in the Progress office, whioh was run by Stephens. Cross-examined a title page in the clfiie of tbe Progress but it is not on the pamphlet.

Saw pages seven and fourteen in the Times-Courier office. The type used in the pamphlet is that assd in tbe Progress office. Have worked in tbis city. Have been in Ihe fa-sating business for about tea years. Suicide.

12 type. Will swear that the pamphlet was printed in Pomona at the Progress offioe. Did not Horace Ball any word about the matter. Don't work for Stephens now and I wouldn't work lor him. Had no ill-feeing against Stephens, except that I had a lawsuit against him for my wages.

I got my money and that ended it. HISS BESSIE BEIL. Miv Bsssie Bell testified she could remember tho birth of her brother seventeen years ago. Her mother bad never been in the Stockton Insane Asylum. After considerable argument as to the admisaabilily of evidence showing the matter complained of lo be false, Justice Taney ruled that such testimony could be admissable.

Miss Bell then testified that she had never known of any ill treatment of her mother by her father and that their rotations were harmonious and bad always been so. Cross-examined was abont six weeks after the birth of my brother that my mother went away and I don't recollect much before that. After the birth of my brother and tbe time my mother went away, I cannot remember of any unpleasantness. Miss Jennie Bell testified that during the past nine years tbe relations of ber mother and father were pleasant. She had never known of ber father abusing ber mother.

BELL TESTIFIES. Mrs. Horace Bell testified tbat she bad resided here about twenly years. The pnblioation of tbe words complained of were utterly false. Never was in Stockton or in an insane asylum.

Never was insane. My relations with jr Bell bave always beeu of tbe very kindest. He bad never spoken aa unkind word to her. Cross-examined away from Los AugeUs in 1870 to Dr. Trainoi's house in Alameda.

I was sick and was sccom. panied by Mr. Bell and Mr. W. Widney.

Had beeu sick for some six weeks. During that time I was flighty at times from ether. Tbe doctor called it acute hysteria. Dr. Trainor's specialty is the treatment of female diseases.

He bad no pa'ienis there treating them for insanity that I know of. I was there under treatment about three months. My relations with Mr. Bell during my trip were perfectly friendly. I was not utile to wait upon myself.

I was weak was assisted by Mr. Bell and Mr. Widney. I did not insist on Mr. Widaey going with me on tbat trip.

1 can remember the things that happened luring the trip. I did uot have compleie control of my mind during the whole trip. Dr. J. Widney wus my before I went away.

1 had Dr. jtritiin early in March. Had not been lick prior to the birih of Horace. After ny return from Alameda there was a man to do tbe work at the house. Had several a omen to work before I went iway.

At the time I went away we had Aunt Biddy Mason and her daughter Harriet. They did not work for us after I returntdj Remember objecting to Dr. Widney's treatment. Had no serious trouble with Mr. Bell about taking the medicine.

He would urge me to take it bat I objected. There was no serious trouble. Hysteria was caused by congestion ot tbe womb and not by mental trouble. Was married in New York city and came to tbis State four years after marriage. MA JOB HORACE BELL.

Major Bell testified that Mrs. Bell bad never been ane nor in the insane asylum. She bad never bad an unkind word from him ai he allowed no one else to speak one in his presence. II is wife bad never been sick in ber life before the birth of the third child. When that child was born it was a cold day and the doors were left open, and sbe was taken with a chill and a fever and tho trouble commenced, and it continued nntil be went to San Francisco.

Dr. Widney was there and insisted upon the administration of sub-cutaneous injections of morphine, to which my wife objected. Mr. Polaski advised me to go to Dr. Trainor's with ber.

I was so worn out with six weeks'watching with- Dut sletp that I procured Mr. Widney to aid me and I paid bis expenses. I talked to Mr. Trainor aud be told me what the matter was and said be conld cure her. I staid there until she was perfectly comfortable, and on the 3rd of May sbe rode out in Oakland.

Sbe came home rosy and has never been sick since. Have never bad a disagreeable word with my wife since my marriage. First saw the circular or pamphlet on the 23rd of February. 1 had known for months that it was being gotten up and who was doing it. I bad written to the War Department to get a transcript of my record.

Colonel Wudge handed me one of these pamphlets. It was read in the Council. Thornton admitted to me tbat he had circulated some of tbe pamphlets. Later in the day I saw Thornton and Wells distributing these documents. Just at tbis time my son Charlie came up and they gave him one.

Thornton had them in bis band, and Wells was with him. This was on tbe 23rd of February. For more than a year past tbe defendants have had a very unfriendly feeling toward me. am the cd.tor of tbe Porcupine. There has been an unpleasantness between the defendants and myself for a year.

First saw tbe pamphlet od the 23rd of February. There was an election of officers that day. The distribution of the documents was before tho election. Did uot see Stephens or Wells distribute the document. Saw Thornton.

I saw- him band it to A. King and to other gentlemen. I was not a candidate for any office or for nomination. On Tuesday evening tbe Express came out and, notwithstanding the previous discussion by the papers, in which my name had never been mentioned, that paper came out and announced my candidacy, and it was a lie. These men took the article to the paper for the purpose of injuring me.

It was a part of the conspiracy. Only one man had ever spoken to me on that subject. At thia point the defense desired to offer in evidence, a document showing tbat Major Bell had only served three months as a Quartermaster's Sergeant, and to ask the witness questions concerning his military record, but both propositions were denied. Cross-examination continued. I am the editor of the Porcupine.

Have been the continuous editor from 1882, At thia point the desired the files of the Porcupine, bnt they were not in court, (and as it was nearly 5 o'clock an adjournment to halt-past 9 o'clock tbis morning was ordered.
