"Provided, Thatuotbiug herein contained shall be construed so as to deprive tbe holder of any claim or demand ot hia nil! to resort to a writ of mandate ur otber proceedings against the said Council or any ulncer of said city to compel tbem or him to act upon said claim or demand." Knt we see no necessity that the Council should put tbe losers of their property to nny further trouble and expense than is really necessary to have their cases brought before tbe conrt. All we nsk for ia fair piny aud no favors.

Henry, Noel Morgan, priest at Wilmington, scuds a note to the BTCTaAZiD stating that the statement in Bumttap Phnei that George Gannaway was drunk when killed by the cars at Ban Pedro April 2d is false. Father Morgan sent a note to tbe Times requesting a correction, hut bis request was refused.

In this note, which is at the Hkkai.i. office, Father Morgan says: "The assertion that Mr. Gannaway was drunk on the evening of the 2d inst. is a calumny. I myself had a long talk with bim at that same evening, and I can declare on oath that ho wan not drunk theu.

m. Saturday all the newsboys Bud bootblacks in the city are invited by the ladies to see the exhibit. Mr. Miller, of Cabueuga, sent tbe famous melon frnit, native of ntral America, and grown on bis ranch in the Cahnenga. To-day all children under 14 years of age will be admitted for ten cents each.

I vet tbem come provided with dimes tbat there may be no delay in making change. The citrus fruit will be for sale at very reasonable prices, for the benefit of the Society. Those who expect to buy any this week would do well to patronize the Festival. Special contributions of flowers are desired for to-day and to-morrow, that the Festival may close in good older, and that recent arrivals in our city may not be disappointed io the show of flowers. Tho Boutoniere booth was forsaken last night for a while, and a bevy of beauty took the place of the young ladies-Miss Lilly (Tiger).

Miss Pearl (of Muddy Water) aud Miss Rosy (with ihe thorn). Mrs. 0. W. Childs sent a spray of Cbroma'ella roses and a greut bunch of the Rougore to the special rose exhibit tbat were resplendent iv their striking beauty even in that lovely collection.

Mrs. Clarke, of East Los Angeles, sent in a Marecbal Niel bud to the same booth, which waa quite aa remarkable, A new rose at this booth is a Marshal! P. Wilder. Different persons have sent this booth specimens of a certain rose, It is marked Levison Gower, Archduchosse Isabella, Superba, Adelaide Rislori, Pink Safrano. and Lauretta.

The ladies would like specimens from all persons claiming to have any of these roses with tbe authority for the name, that the true names may be learned. Local News Notes. The Southern Pacific Company yesterday sent out a special of teu cars of oranges.

LUCK AND ROMANCE. How a Cigsr-nakcr and a Fair Friend Profited. There is seldom so much romance In luck as io that which befel Fred Welp, a young cigar-maker, Inst Tuesday. Wulp, wbo is only 19 yearsoM, has been hard at work for some time in the factory of Hugo Herbaus, on the corner of Montgomery and Clay streets. By his side sat a pretty giVt, engaged also in making cigars, and Fred -and his fair companion wcame excellent friends in a short time.

A few weeks atro they together bought four conpous for the March drawing of the Louisiana Stato Lottery, agreeing to divide costs and innings. Two days later the agent ontered tlie shop, and the girl said that she felt sure ff another coupon was bought tbey would "make a winning." Fred agreed, and a ticket, wbicb they said, as before, tbey would share cost and winning. Lust Tuesday evening the lottery ageut malted to the cigar store in front of the factory, and informed tbe proprietor thut he had won the grand prize. The proprietor was nearly crazy with excitement, which somewhat abated when he was made to understand that tbe "you" meaut the shop. Tbe telegraphed list of ings was consulted, and it was found the fifth coupon bonght by Welp aud his fair work companion was the lucky one.

Welp was soou found in the Wigwam Theatre, and when told of his luck his joy was as openly expressed as a boy's over a vacation. The first remark he made, however, was: "Well, she owns half the ticket, remember that. Half the money goes to her. How much is it?" "Fifteen thousand dollars," he was told. "Fifteen What! Well, if it's as much as that I guess I'll have to marry her, to keep the money in the family." The young cigarn aker said this witb a good-natured blush; but as his and her bench were vacant at the shop yesterday, it is shrewdly suspected tbat they have agreed to sot up a white cigarmaker's establishment of their Sau Francisco Chronicle, March 19th.

Fencing and Sword Exercise. Los Anuklek, April Bth, 1886. Editor Herald: It was my privilege and pleasure to attend on last Monday evening a highly interesting entertainment at Merced Hall, given by Professors Gibot and Leplat, assisted by some of their students. It consisted of fencing, or sword exercises, together with various other athletic performances. The fencing was eapeciaily praiseworthy.

1 Few Angelenos are aware that we can I boost of having amongst our citizens such talented professors of tbis attractive art as the above gentlemen. Prof.Oibot, though carrying the marks of time on his flowing locks, exhibits in his every movement such a degree of energy and agility as puts his whole 1 class to the blusb. From a medical standpoint, we can say, but few can long endure unscathed the conflict between Life and his eternal enemy Time, without some sort of vigorous exercise. Here is an opportunity for the pale, flimsy-muscled youth to avail himself of, a reputable recreation, partaking at the same time of pleasure, health and utility, seldom found in such small places. These gentlemen, I understand, give evening lessons; and bow infinitely better it would be for our young men to spend a couple of hours in this manner, after business hours are closed, than to (spend ihein at the gaming table, or at I places still worse.

All physiologists know that walking is one of the very best health-giving exercises. But walk- I ing is work, and there is so little in it to attract, that only a few of the intellectually stalwart ever muster enough moral courage to derive much benetit from it. Tho art of fencing also embraces the labor feature, a fact that its votaries will very soon discover; but here emulation ami prowess come in to stimulate and and when skilled, the cheer, or tbe hiss lends a vigor to the nerves that produces a reaction throughout the entire system qiial to a shjck from a powerful e'eetrie battery Here the whole muscular system is brought into action, equal to that produced by any known athletic sports. Not only is the appetite stimulated, aud the digestive powers of tbe system strengthened, but the muscles are toned and developed, thus attracting aud accelerating the process of assimilation of food to tbo various tissues of the body; and without proper assimilation, no matter what the Quantity or quality of food, tbe blood is impoverished, and disease follows as a natural consequence. Again, while our regular army is too small to otter many opportunities to learn the arts of war, it is well lo know that wo have in our midst masters of many years experience across tbe Atlantic, 'nnd who are in every respect thoroughly competent to put into the possession of our young men wbo may be of a military turn of mind an aeeomplishmcnt that may one day serve them well in some part of the civilized world.
