PEARISBURG (AP) circuit Judge W. S. Jordan has upheld the 1953 murder Conviction of a state penitentiary inmate. Walter R. Munsey, serving a term for one slaying and 20 years for a second, for a writ of error and a Richmond court granted the' special hearing here to determine if there were sufficient grounds to warrant a hew trial.

Munsey, of Giles County, now 46 years old, pleaded guilty in 1953 to the slaying of the wife of one of his brothers and the son of another. He drew the life term for the murder of his sister- in-law and 20 years 'for the death of the boy. serving about eight years, Munsey petitioned for a writ of habeas corpus contending he was not properly represented at his trial, that he was deprived of some of his constitutional rights, and that lie had been illegally imprisoned. Judge Jordan, of Radford, was named to hear the case when Circuit Judge V. L.

Sexton who presided at the 1053 trial, disqualified himself. Church Leader Dies in Calif. (AP) The Rt. ReV. Edward Lambe Parsons, 92, who retired in iEHO after serving as Episcopal bishop of California for 21 years, died Monday at his home.

WEDNESDAY, JULY 196ft Business News Giles Sheriff Is Acquitted Of Charge PEARISBURG AP Giles County Sheriff John E. Hopkins Jr. has been acquitted of a charge of malicious wounding and that grew out of a scuffle be- 73- tween him and a longtime friend, taxi driver Clarence F. Lambert. An all-male jury in Giles Codrity Circuit Cdurt deliberated 2 hours and 45 minutes before returning its verdict late yesterday as the end of a trial that began Monday morning.

Hopkins, 49, serving his second term as sheriff of the Southwest Virginia county, insisted the June 17 shooting the 3fe-year-old was an accident. Th'e rriajof testimony during ihe trial was presented by Hopkins arid Lambert. About the only point they agreed on substantially was that ihey had been friends for a Ion time. Lambert said the scuffle occurred after he and Hopkins had held a parly that included drinking and conversation. He said he was starting to open a door Hopkins hit him on the head.

He said he remembered being shot in the left arm as he tried to get up off the floor. The sheriff said Lambert hailed him down and told him he was "going to kill a man." He said he took one drink of vodka for an attack of asthma. Hopkins said the scuffle occurred wtyen he refused to arrest a former girl friend of Lambert's.
