FOLEY Gazette State Bureau HELENA Legislation was introduced Monday seeking to gain a hurry-up answer from the state supreme court on several sticky questions affecting plans for a constitutional convention. In November, the state's, voters approved the calling of a-convention to re-write the 82-year-old document. Details are; to be worked out by the 1971-assembly. old document.

The legislation, which is expected to be rushed through both houses in the next several days, would authorize Atty. Gen. Robert L.

Woodahl to bring a friendly suit asking the high court: 1. Whether convention delegates should be apportioned on the basis of the house of repre-. sentatives before or after reapportionment scheduled for this session 2. Whether delegates may be elected on a non-partisan basis rather than as Democrats and Republicans. 3.

Whether state and local elected officials including legislatorsmay serve as convention delegates. Harris said the commission hopes to have the answers to the questions By the 20th legislative day, the deadline for introduction of bills. An enabling act for the constitutional convention would have to be introduced by that day. BECAUSE of the need for fast answers, the legislation would authorize Woodahl to skip district court proceedings and go directly to the high court in asking for a declaratory judgment. The constitution revision commission thinks that the legislature should take the position that delegate apportionment be based on the existing house, that delegates be elected on a nonpartisan basis and that elected officials be eligible to serve as delegates The legislation authorizes the Cascade County Clerk and Recorder and County Attorney to take the opposing views in the friendly suit.

That is necessary for the court to have legal disputes on which to rule. The legislation was introduced by four senators who served on the Constitution Revision Commission: Jack McDonald, D-Great Falls; John Lyons, R-Shelby; Jim Moore, R-Two Dot; and Harry B. Mitcheil, D-Great Falls. By JERRY HOLLORON Gazette State Bureau HELENA Legislative leaders expressed strong doubts Monday about whether the 159-member legislature will reduce its size this session. The main problem, according to House Speaker James P.

Lucas and Senate Majority Leader Dick Dzivi, is time: They fear the legislature, beset with many major issues, simply won't have the time for what probably would be a lengthy fight over any substantial cut in the size of the 104-member house and the 55-member senate. THE LEGISLATURE must reapportion its membership this session because of population shifts shown by the 1970 census. Pressure has been building for the legislature not only to reapportion itself, but also to trim its size, which many believe is unwieldy. rrest's Tsax Special reapportionment committees will be set up in each house and Lucas, a Miles City Republican, and Dzivi, a Great Falls Democrat, have informally agreed that the first effort of those committees should be directed at reapportioning the two chambers at approximately their present size, Lucas said. The result would be that fast-growing areas, such as Missoula, Billings and Helena, would gain legislators at the expense of rural areas that have lost population.

"We're hopeful we can avoid the time involved in getting into single-member districts and the size of houses," Dzivi explained. "Single member districts" means that the state would be divided into districts so that each person would vote for only one senator and one representative. At present, voters in the more populous areas cast ballots for as many as 12 representatives and six senators. LUCAS AND LlZIVI also noted that the question of size of the legislature can be considered by the constitutional convention that was approved by voters last Nov. 3.

Thus, the argument goes, the constitutional convention may have more time to deal effectively with the question of legislative size than will this year's 1 However, Lucas said the special legislative reapportionment committees will consider shrinking the size of the legislature and such questions as single-member districts if time permits. "It will depend on the burden of work from other things," he said. Meanwhile, another method of reapportionment which could tie in a decrease in number of legislators probably will be presented to the legislature. Sen. David F.

James, D-Joplin, had copies of a proposal drafted by University of Montana Political Science Prof. Ellis Waldron to establish a legislative apportionment commission. UNDER THIS PROPOSAL, which James said has been used successfully in other states, the legislature would establish a commission consisting of the Senate President Pro Tem (Sen. William F. Hafferman, D-Libby); Senate Minority Leader (Sen.

William L. Mathers, R-Miles City); the House Speaker (Lucas), and the House Minority Leader (Rep. E. Christiansen, D-Hardin), or a person of their choosing. The four would select the fifth member from the general public.

The five-member commission could hire a staff and would be charged with coming up with a reapportionment plan by the 50th day of the legislative session. The plan would go into effect as recommended by the commission unless amended by the legislature. Herbert J. Klindt Monday asked that two additional members be added to the powerful committee. Klindt's motion, made as a point of privilege, fell like a bomb in the silent chamber and took most of the upper house legislators by surprise.

The Billings senator claimed that "the two largest areas by taxable valuation," Silver Bow and Yellowstone counties, represents one-third of the taxable valuation of the state, yet they're not represented on the committee." That, he said, is a "luxury" that Montana can't afford, considering the state's lack of economic growth. A major increase in the Montana income tax plus the expected federal increase in social security charges would be "punishing," the Miles City attorney said. By ARTHUR HUTCHINSON Gazette State Bureau HELENA The State Liquor Control Board will ask the legislature to require breweries to pay the state's beer tax directly to the board, by passing the wholesaler who now pays the tax based on monthly sales.

The board also will ask authority to audit the books of the two distilleries in the state, Alpha Industries of Helena and Jo-vene Inc. of Columbus. ADDITIONALLY, it will sponsor bills to remove the current ceilings on salaries of liquor board employes and an obsolete debt limit for liquor purchases by the board of $25,000 a month. The proposed bills should have a fair chance of passage because all were originally recommended to the board by the legislature's audit committee following a critical study of the liquor monopoly's business practices. The state's existing beer law requires breweries to make monthly reports of how much beer it sold and to which wholesaler in the state.

The wholesaler also must report how much beer he received and how much he sold. It is on the sales that the tax currently is paid. THE AUDIT committee complained many beer wholesalers did not file correct and complete reports and the board did not audit wholesaler's records or inventory their warehouses.
