The suit is the latest salvo in a food fight that began in February, when Chodorow filed a lawsuit charging DiSpirito with wasting money while running the Italian restaurant But in a countersuit filed in Manhattan Supreme Court, DiSpirito put Chodorow on the grill, accusing him and his company, China Grill Management, of cooking the books at Rocco's to make it seem as though it's losing money. China Grill Management's lawyer, Laurance Kaiser, called that allegation "categorically untrue." DiSpirito also charges his ex-partner with changing the locks on the restaurant and refusing to give him a key. DiSpirito's lawyer, Jane Stevens, said her client now "has no control over the restaurant" "The Restaurant" kicks off its new season on April 19 at 9 p.m.

"They continue to jeopardize everybody in this city," Bloomberg said of contractors working at the troubled skyscraper. "We are not going to have to walk down the streets and look up all the time at a building wondering whether something's going to come off it." Jake Clark, 60, was not seriously hurt when the metal chunk grazed his arm, missing his head by inches, amid high winds.

But Ilyse Fink, a spokeswoman for the Buildings Department, said Related Management Company was hit with two summonses Sunday, including failure to safeguard the public and property. They've been ordered to come up with a safety plan, she said. The city's 48-hour stop-work order follows several summonses issued to construction companies for falling material at the complex at Columbus Circle. Building management blamed high winds for Sunday's dangerous free-fall. Workers have inspected the 3 acres of roof space "to insure that all areas are free of debris," according to a statement.

"We continue to cooperate with all local agencies to insure the safety of the area," the statement said.
