He was retired from NCR and CPI, a member of Dayton Lodge 147 and NCR 25 Year Club. Preceding him in death were his parents, Clint and Iva Fenner and a grandson, Brett Ey-soldt. Surviving are his wife, Mildred; 2 daughters, Sandra Roche and Joe Sengl, Vicki and her husband, Dick Wilson; 3 grandsons, Scott, Billy, Stephen; 2 brothers, Ronald and his wife, Jean Fenner of Oak-wood, Robert Fenner of San Diego, CA; several nieces and nephews. Funeral services 11:00 AM.

The decision reverses a ruling by the 10th Ohio District Court of Appeals and reinstates an Ohio Court of Claims judgment. It excludes cases in which troopers are found to have acted with willful or reckless misconduct.

On Aug. 3, 1989, Steven E. Baum was stopped in traffic at a roadblock set up on Interstate 275 near 1-74. Hamilton County sheriff's deputies had set up the roadblock, without telling troopers, to capture a 14-year-old boy who had taken a neighbor's car for a joyride. While Baum was sitting in his stopped car, a patrol cruiser that had been pursuing the stolen car struck his vehicle from behind, injuring Baum.

He and his wife filed for damages with the court of claims. Justice Francis E. Sweeney, who wrote the Supreme Court's ruling, said the patrol "is under a legal duty to pursue fleeing lawbreakers. In performing this duty for the public, the State Highway Patrol is permitted to take greater risks which would amount to negligence if carried out by private citizens with no emergency duty to perform." FULK, Pauline 'Polly', age 64, of Trotwood, died Thursday, July 13, 1995. She was a graduate of Roosevelt High School class of 1949, Hanover College and W.S.U.

She was a member of Triumphant Cross Lutheran Church and retired as a teacher from the Trotwood City Schools. She was a former member of Sweet Adelines, Gem City Chapter. Preceded in death by father, Paul Keefer. Survived by husband, William B. 'Bud'; mother, Sue Keefer of Dayton; 3 sons and daughter-in-law, Joe of Dayton, Bill and Lori of BrookviUe, Tom of Trotwood; 4 grandchildren, Travis and Tyler, Kyle and Kelsey; and other cousins, family and friends.

Julie was a graduate of Chaminade-Julienne High School (1977), attended Sinclair Community College, and had taught Graphic Arts at the University of Dayton. Family will receive friends Friday from 4 to 8PM at the funeral home. Julie was deeply loved and respected in both her personal and professional life.

Her family asks that she be remembered for her love, generosity, and enthusiasm for life. He had worked as a fanner, a guard at Wright-Patterson AFB and was a fine finish carpenter working with many of the well-known builders in the area earlier on. Jim had been a loving and faithful member of Franklin Street Baptist Church (Centerville) since October 1961. Rev. Dr. CARSNER, Billy L. age 64, of 77 Laurel West Milton, passed away Wednesday evening at home. He was preceded in death by his parents, Earl Alonzo Lottie (Wyskiver) Carsner.

Survivors include his wife, Josephine I. (Basdasaro) Carsner; sons daughters-in-law, Leonard Susan Carsner, Piqua, Raymond Si Melissa Carsner, Huber Heights, Doug Si Kathy Carsner, Union, Jerry Carol Carsnar, Huber Heights; daughters sons-in-law, Charlotte George Wells, Bell-brook, Jeannine Si Steve Carey, Dayton; grandchildren, Austin, Phillip, Ashlee, Brad, Ben, and Robert Carsner, Elizabeth Wells and Patrick Carey; brother sister--in-law, Scotty Barbara Carsner, New Lebanon; and several nieces and nephews. He was formerly employed at NCR for 23 years in the Heat Treating Department and retired from American Heat Treating in Jan. of 1903, and was a Veteran of the Korean Conflict. Busch Sr. Survived by her devoted husband of 27 years, Thomas F. Endres; daughter, Loraine K. Endres, M.D.; son, Edward J. Endres.

MOGLE, James Lee, 55, 361 Windsor Park, Centerville, formerly of Darke County, died at Miami Valley Hospital in Dayton, OH on Tuesday, July 1 1 1 995 Mowing a motorcycle accident in Darke County. He was bom in New Madison, OH on July 28, 1939, the son of the late Delia Mogle and had lived in the Darke County area most of his life. She preceded him in deathin 1976. He retired from Dick Lavy Trucking Company in 1989 and served in U.S.

Navy during the Vietnam Conflict. He wasamem-ber of the Laroy Farst Post 245, American Legion ln New Madison, V.F.W.Post3438inWest Carrollton, OH, Loyal Order of the Moose Lodge 1645 in Miamisburg, Faternal Order of Eagles Aeere 2177 in Greenville, OH, also the Elks Lodge 1139 in Greenville. He is survived by his wife, Margaret (Hensley) Mogle; two sons, Kevin of Po-tasky, MI, James Mogle Jr. of Lafayette, IN; two daughters, Jamie Ricks of Lafayette, IN and Mrs. Jeff Jodl) Luke of Harrison, OH; several aunts and uncles; and numerous cousins.

His brother, Robert preceded him in death, April 16, 1993.
