Members of the Sl Louis bar are being condemned as unprofessional because they are alleged to have sought and initiated litigation arising over deaths from silicosis. The lawyers are accused of champerty just as the so-called ambulance chasers in Milwaukee were some years ago. Often people who have a right to tort actions arising out of conditions that bring about sickness that results in death are not aware that there is a legal basis for their claims.

They also frequently have not the money to pay for the preparations for the legal actions necessary to determine their rights. The result is that some lawyers solicit this business and take it on contingent fees. The cry is immediately raised of unprofessional conduct. It is customary, however, for attorneys to apply for positions on the legal staffs of large, corporations. The question has never been raised that such applications are unprofessional.

Apparently to solicit employment from the poor is wrong but to look for employment in legal berths where there is a high salary remuneration is legitimate. The bar investigation that grew out of the "unprofessional" charges in Milwaukee resulted in some legislation that was a protection to clients whose suits are brought on a contingent basis. The regulations that are now thrown around such employment by attorneys have proved satisfactory in Milwaukee county. The St. Louis bar association which is investigating the silicosis suits might do well to study the evidence taken and the results obtained from the Milwaukee county inquiry which was conducted under the direction of circuit judges and looked into all phases of contingent fee litigation.

Members of the committee against whom aspersions have been cast, and who enjoy the legal presumption of innocence, are entitled to a thorough and searching inquiry through which alone they can arrive at vindication.

The taxpayers of Dane county, who foot the bills for county governmental administration whether it be good, bad, or indifferent, are entitled to an investigation that will go to the bottom of the matter. Such an inquiry will be a big task, and may require several months of examination and investigation. The investigation can be relied upon to disclose the actual truth only if it is conducted by a trained lawyer expert in examination, cross-examination, and investigation. The district attorney's office is a busy one. He could devote himself to such an inquiry with, such application as is necessary to turn up all the facts, only at the cost of neglecting his regular duties, among which is the Miller defalcation trial.

To say there is a lawyer on the committee does not answer the question. A lawyer member of the committee has his own practice to attend to. He performs his full duty as far as his membership in the county board is concerned when he attends its meetings and considers matters before it with due deliberation. It would be futile to expect him to give several months of hard work, without pay, to so arduous a task. The only alternative to the appointment of an assistant to the district attorney in this matter would be a grand jury.

We do not like grand juries. They are more apt to be inquisitions than investigations. All that is needed here is a thorough investigation. And the cost of a grand jury would be many times over the cost of an assistant investigator before a competent investigating committee of the county board. Too much has been said to let this affair go "with a lick and a spit." Justice to those vno have been criticized, and to the taxpayers of Dane county, requires a thorough-going probe, and no part of it behind closed doors, as a county board resolution would authorize.

The state board of health claims that the foothold that has been obtained by scarlet fever in the state has been caused by the carelessness of parents in failure to isolate border line and mild cases of the disease by enforcing quarantine regulations. Citizens should take cognizance of this warning immediately call a physician when any member of the family shows symptoms of the disease. Scarlet fever can be kept in check through quarantine measures. The disease is dangerous and often fatal.

Precautions against its spread should be carefully enforced. Scarlet fever is not yet in epidemic form in the state. The carelessness that has permitted it to gain a foothold should be succeeded with great care. The people of Wisconsin have it in their power to stamp out the disease. The welfare of the state demands that this be accomplished.
