Is Agency's Fate to Directors By HENRY HARRIS, Daily News Staff Writer Montgomery county ditions for further support agency on the line Monday of the agency's board of Noting that a May 1 deadline had been set, Commission President Charles V. Simms told Montgomery County ComAction agency board. members and executive director Melvin J. Jackson, "I think, issue it's now The time to question resolve is whether you will agree to permit the Montgomery county auditor to act as fiscal officer for the CAP (Community Action agency program) funds." THE MEETING, taken up mostly with arguments, appeared to leave the fate of the agency, as far as further local government support goes, in the hands of the agency's board. And board, according to President Herman Lander, is apparently in no position to take added responsibility.

Commissioners are asking the board not only to accept County Auditor A. L. (Tom) Oswald as a over the anti-poverty fuwatchdog, ture spending, but also to approve a budget for the agency and separate expenditures before they are made. Commissioners threatened to withdraw support from the unless the board goes lorency Lander protested that Simms is paid to be a county commissiner, but anti-poverty agency board members are serving "on a volunteer basis, and you're saying we sit there and approve all expenditures?" Cloud said the agency should be able to "operate under the same rules the rest of the county (government) operates under." JACKSON protested that the agency can't do that and still comply with rules of the federal Office of Economic Opportunity, the parent funding source. Zane Haught, a manager in the Dayton office for the Alexander Grant Company, which audited the agency's books, said it is necessary for the agency to follow 0E0 guidelines. "Any grantee that does not follow 0E0 regulations and can't' follow OE0 regulations just can't be funded," Haught said. THE FIRM'S latest audit of the agency books, for the year ending Nov. 30, 1973, noted among other irregularities, violation of Office of Economic Opportunity rules against paying retainer fees.

The auditing firm said the agency avoided making contracts where contracts were called for, had work done apparently unrelated to the antipoverty program and repeatedly ran up unnecessary costs. The audit, done Mar. 11 and released last week, questioned a total of $216,254 in agency spending ofr the audit year covered. IP Barbie Lewandowski, a blonde and shapely grade school teacher's aide, is fighting to save her job after posing nude for the centerfold of a men's magazine. "As far as lam concerned she is through," said William Knapp, superintendent of the suburban Greendale school 1 where Miss Lewandowski has corrected papers and done odd jobs for seventh and eighth grade teachers for the last two years.

But Miss Lewandowski, 25, who for $2,000 struck 18 nude poses of her 37-25-37 figure published in this month's Penthouse magazine, says she will go to court if necessary to keep her job. "DR. KNAPP says I quit, but I didn't," she said Monday. "I went in to talk to him last week and said I might quit if 1 thought it would be impossible for me to do my job this fall, but we just left it up in the air." Knapp, who said he has seen the photos but has no personal feeling about Miss Lewandowski's job, insists "She resigned. That's it." She said she does not believe publication of her picture in the buff will affect her ability to do her job.

"I'm still the same old me," she said. "I can still goof around with the kids and everything just like I used to. I think 13-year-old kids can accept this. Besides, most of them will probably never see the picture unless their mothers get upset about jt." Funerals FRANKLIN: William H. Gillespie, 86, of 108 Jackson Sunday.

George said he had accidentally hit his wife on the head with her needlework box. "Somehow that developed and I put my arms around her and strangled her.
