DAYTON DAILY NEWS Monday, July 17, 1972 Maryland Prison Riot Leaves Eight Injured Teamsters Union Funds Case Dead DETROIT (UPI) The government will not prosecute Richard F. Fitzsimmons, son of Teamsters union president Frank Fitzsimmons, on charges involving the handling of union funds because "there's just no case," says a Justice department spokesman. The younger Fitzsimmons. grievances. He said there were no demands voiced by the inmates.

Specifically mentioned, the governor said, were the areas of medical service and the classification board, which assigns inmates to the various institutions within the state corrections system. As of early today there were still no communications within the and predominantly black institution. INITIAL ESTIMATES of damage ran as high as $1.5 million. "It was the worst damage I've seen," said Gov. Marvin Mandel, whose agreement to meet with an inmate delegation finally prompted the last few hundred of the rebelling prisoners to return to their cells about 5 a.m.

Wi The Maryland House of Correc-t i remained quiet early today as officials tried to assess the situation at the maximum security prison following a 12-hour riot that left four guards and four inmates injured. State prison officials planned a news conference today at the sprawling, rural facility to answer questions about the disturbance. The Inmates' routine continued to normalize Sunday as Warden Ralph Williams and others started to estimate the damage resulting from the rampaging inmates and the many fires that erupted sporadically almost from the onset of trouble that officials said began Saturday evening with an escape attempt in the outdoor recreation yard.

Hoffa. Hushen said the repayment does not prove guilt. "What the Labor depart-ment gave us was a bunch of assumptions and you can 't take assumptions to court," said Hushen. "We sent it back to them and said if they have further evidence we would take another look at it.

If the case had involved anyone other than Fitzsimmons we probably wouldn't have looked at it in the first place." UPt Telephoto WAR DAJSCE? in a wide area of the Roxbury and South End sections following the festival, which was attended by 8,000 to 10,000 persons. A police car and a cab were overturned and set on fire. A tavern and a branch City Hall were set on fire with fire bombs, but the flames were brought under control quickly, police said. Police said the disturbance broke out about 7 p.m. when two factions attending the second day of a two-day festival marking Puerto Rican Independence Day engaged in a fist fight.

BOSTON ll Police blame "the heat and too much beer drinking" for a rock-throwing rampage involving an estimated 2,000 which broke out following a Spanish-speaking festival here. Nineteen persons were reported injured and at least 35 persons were arrested in the Sunday night disturbance, police said. Of the injured, six were policemen, including one who suffered a broken arm when struck by a tire iron. TWO INJURED persons were hospitalized in critical condition. Police said numerous other persons suffered minor injuries mainly from fi fl r.lfffl Andrews Stresses Role of Youths CLEVELAND -W- Republican State Chairman John S.

INFORMATION that the card had also been used for other purposes also was turned over by the of Labor to the Justice department. The Detroit Free Press, in its Sunday editions, said the evidence had been gathering dust for more than eight months and added that sources said the reason no action had been taken was because of political pressure. Jack Hushen, i department information director, stud the decision not to prosecute the younger Fitzsimmons was made more than two months ago and said "there is just no truth" to allegations that political pressure had been brought to stop the prosecution.

"THERE WAS just no -proof," Hushen said. "We told the Labor department there was no case." The relationship between the elder Fitzsimmons and President Nixon is closer now than that of any other major union leader and the i t. There are indications the elder Fitzsimmons will throw the support of his 2 million-member union behind Mr. Nixon in the November election or at least remain neutral. The Free Press quoted one unnamed source in Washington as saying it was conceded in Government circles, "You had better be damned sure of your case if it involves anybody named Fitzsimmons." BUT HUSHEN SAID the decision not to prosecute "was made at the aareer level and the attorney who made it is a Democrat.

The decision was made by William Lynch, head of the Organized Crime and Rackets section of the Criminal division." From Dolly News Wirt SarvicM REYKJAVIK, Iceland -World chess champion Boris Spassky resigned the third game against Bobby Fischer on Monday five minutes after the clock was switched on to resume their adjourned game. Referee a Schmid opened Fischer's sealed 41st move. It was bishop to queen six.

Fischer was not in sight. SPASSKY waited only minutes, and knocked over his king, giving the game to Fischer. The score in the 24-game match now stands at 2-1 in Spassky's favor. Spassky walked off the stage as the spectators in the auditorium sat in total silence. The Russian had lost his first game over to Fischer.

Spassky had been playing white, which gave him a slight advantage. FISCHER'S sealed move had been predicted as the winning move by all grandmasters watching the game. Earlier, Schmid had upheld a protest from Spassky and moved the adjourned third game of the $250,000 world chess championship back into Reykjavik's main sports hall, session Saturday, where i 's representative walked out in protest. IN FIVE previous meetings, Fischer had never beaten Spassky. He lost three playing black and drew two when he played white and had the first move.

Fischer needs 12', points to dethrone Spassky while the Russian can retain his title with only 12. A player gets a point for winning a game and half a point for a draw. Spassky won their opening game at Reykjavik last week and was declared winner of the second by forfeit when Fischer failed to appear because he objected to hidden television cameras filming the match. He said there was noise from the streets outside, he could hear children play and the light and the chess board were not up to the highest standard. The matches were to be played on a specially designed slate table weighing almost 300 pounds. Schmid told the Russians that it had not been possible to transport the table upstairs, sources said. "I weighed the two playing venues against each other and decided to move the third game back into the big hall," Schmid said. THE GAME was moved backstage Sunday after Fischer protested against the presence of closed circuit television cameras and threatened to fly home.

Schmid said today's meeting was "peaceful and quiet" in contrast to a stormy midnight "And I say my opponent has become infatuated with the sound of his own words." 13. KT-OB4 KT-K4 14. KT-K3 Q-KR5 15. B-Q2 KT-KKT5 16. KTXKT PXKT 17.
