Apply at thlt office, mailMiw on a rail and tore his clothes and very badly bruised and injured him, and demands in damages five thousand dollars. For the defence it is claimed that the plaintiff was a person of doubtful loyalty and had, at various times, discouraged enlistments, and had made some disgraceful remarks about the union soldiers, referring particularly to the defendants, and had said among other things that he would not cheer for the union flag. That they went as union soldiers and as a company to have him set himself right in regard thereto, and said to him that if he would cheer the flag even they would 'be satisfied, but that he refused to make any acknowledgments and on request to cheer the nag the plaintiff stated that he "hadn't cheered the flag since Harrison's time and shouldn't do it," and that they merely treated him to a gentle ride on a rail doing him no bodily injury.
