Gen. Robert Kennedy has sworn to topple Teamster Boss James Hoffa as a menace to unions and the country. WASHINGTON (UPI) The Food and Drug Administration (FDA) Tuesday announced tighter new regulations, spawned In part by the 1962 thalidomide scare, to safeguard the drug-buying public. The regulations, to become effective Apr. 1, would: ONE.

Require manufacturers seeking FDA approval of new drugs to prove the drugs not only are safe but are effective. TWO. Forbid misleading or false labeling and advertising by drug manufacturers. THREE. Require drug manufacturers, processers, and packagers to register with the FDA each year and to be FDA-inspected at least once every two years.

Under Old Law The revised rules stem from the 1962 Kefauver-Harris amendments to the Food, Drug, and Cosmetic act The amendments, once stalled in Congress, were enacted speedily after hundreds of women, especially in Britain and Germany, who bid taken thalidomide gave birth to deformed babies. An FDA spokesman explained that, under the old law, only the safety of drugs had to be proved to win government approval Now, be said, "clinical data must be adequate to support a reasonable conclusion that the drug will be safe and that it will have its intended therapeutic effects." He also said that some clinical testing must take place in the United States unless the disease to be treated doesn't occur here. Final Printed Label After approval, manufacturers would be required to report to the FDA periodically on the actual effect of the drug on humans, including immediate reports of unexpected side effects and failures. The final printed label must be submitted before the new drug is approved. Afterwards, all new advertisements and mailed promotional information on prescription drugs must be submitted to the FDA.

All labels must be worded as clearly as possible, the FDA said. The regulations crack down on "artful wordsmithing," fancy but meaningless names, mention of inactive ingredients, and use of trade names whose spelling and pronunciation might lead to confusion with other established trade names. Clearance Not Required Advertising claims would be restricted to those appearing on FDA-approved labels. Any drug eivertisernent that suggests dosage must summarize side effects and hazards, the FDA said. FDA clearance of advertising will not be required.

But the FDA can require advance approval of an advertisement if the potential hazards of a drug's use are great enough. If an advertisement is "seriously misleading," the FDA said, the drug involved can be taken off the market The FDA said the registration requirement will not apply to the corner druggist nor to wholesalers, to manufacturers of such harmless ingredients as color additives, nor to laboratories manufacturing drugs for research, teaching, or chemical analysis. It is aimed primarily at manufacturers or their laboratories and any firm that repackages or relabels drugs for sale.
