Tbat has been Teferred to the treasury department as whether or not the war department has the right to au thorize Cuban vessels to fly the Cuban Bag under American ensign.

There is no question but that the treasury depart ment will decide there Is no existing law which would Justify this step. The matter will then, be referred to the at torney general for his opinion whether. under tbe broad construction of law, military occupation of Oils country can authorise the use of this combination of flags and enforce its respect in ports ot loreign countries. This also may raise tbe question as bow far this course would commit the United States to recognition of the Independent rights ot Cuba, a step that' this government so far studiously avoided.
