M. Sutton Was Remandad For Trial. Supreme court reconvened at 10 o'clock for the purposes of rendering decisions. Three respondents were on baud to hear the decisions in their cases. The docket was called shortly before noon and at 1:30 this afternoon the court beard the motion in State vs.

John f. Klnball. Orange county, to strike off the entries made, and permit the case to be argued in supreme court. In this case the respondent did not appear in supreme court when his case was called and the court waived the exceptions and ordered the bail of $3,000 forfeited. The respondent was -afterwards found at Randolph and arrested.

He was brought here yesterday on habeas corpus proceedings and the -motion made to Btrike oS the order of court that he be sent to the lower court for sentence. The case is for adultery. The case of State vs. E. M.

Sutton, former mayor of Burlington, for alleged defamation of the supreme court, was remanded. The exceptions were overruled and the indictment held sufficient. The case had gone before the court on demurrer by the respondent that the indictment was insufficient, the court holding that it was. In State vs. Frank A.

Fogg, Windsor county horse stealing case, exceptions overruled as to the main case and on peti tion for a new trial, verdict Bet aside and new trial granted. Those are the decisions: WASHINGTON COUNTT. A. B. Hutchins vs.

Barre Water com pany, assumpsit. Judgment for plaintiff for amount of tax and costs affirmed. Watson, read opinion. In re William Jennison, judgment that the relator was unlawfully restrained of his liberty, and ordered discharged from custody. This is the case of a Marshfleld man taken on a horse case, whose duty the deputy did not coesider it to be to take him to the place' of trial in Marsh-field.

He was confined in jail several weeks. State vs. K. M. Sutton, defamin court, exception of respondent overruled and judgment that indictment be held sum cient and cause remanded.

Judge Rowell delivered the opinion. The Washington county cases with the court are John Kelley vs. State of Ver; mont, H. E. H.
