Mllo Felghtaer, one of the attorneys for Charles K. Helney, plaintiff In the salt against the' school corporation of Andrews, which was decided in favor of the former bjr Special Judge Morris In the Huntington circuit court, says that he will have his' brief ready to file in the appellate court the lat ter part of the week. Lesh ft Lesh, attorneys for the Andrews school cor poration, which lias taken the appeal, have already filed their brief. Mr. Feightner says that the appellate court has intimated that It will render a decision In the case within sixty days.

HunL The case was filed by Mr. Helney to test the constitutionality of the act of 1911 governing the location of school bouses, and was the outgrowth of the avowed Intentions of. the An flrews high school board to erect the new lgh school building In Andrews on the site of the present high school building. held 4hat the new build ing' inust'be erected on another loca tion In compliance with the state law, which states that 'a school building must he situated, more than 500 feet from a railroad.
