Magistrate Frank A. Pcr- dew, who heard the case, fined Lincoln $5 and costs on the charge of disturbing the peace near a public highway, but Defense Attorney Estel C. Kelley, immediately appealed for a jury irinl. COMMISSION TO STUDY SANITARY CONDfTWNS Mayor Irvine Says City Will Name One Member as Requested by Legislature In conformauce with ft joint resolution approved at the last session' of the General Assembly, Mayor Harry Irvine uld today the Mayor and City Council will name a member to a seven-man commission which wUl study sanitary conditions in Allegany county. A copy of the resolution was received today from Francis Petrott, secretary of state.

It provides that the Allegany County Commissioners shiil name four members, the Mayor and City Council of Cumberland one, with Che director of the State Department of Health and the chief engineer of the Public Service Commission completing the group.
