Title to that property had been delivered to the village of Middletown by its Board of Education in 1880 for $4,000. In 1920 additional property on Orchard street was acquired by the city for $5.000 from Genevieve E. Denton. In 1892, Mr.

Ballman found, the legislature enacted three laws intended to establish a new public library system entirely separate and distinct from school libraries. The laws provided for incorporation of public libraries by the Board of Regents. One specifically required that school libraries be kept in school buildings and should not be used by the public. These laws, moreover, gave to the Board of Education the discretion of giving books not needed in schools to establish public libraries. In the event public libraries were established, boards of education were given permission to appoint three library trustees to administer the public library.

The statutes of 1892, however, required that such trustees should apply to the Board of Regents within one month for a library charter. "The Middletown Board evidently intended to comply with the law," Mr. Ballman asserted, "for the reason that they appointed three members of the Board of Education as a library committee."
