A jury delib erated one hour and returned the liberty giving verdict, and Hogan walked home a free man for the first time in many morns. Thus ended the sensational murder case which had at stake the paramount issue; whether a man can protect his home from the frenzy of an assassin and be justified in the Tittsburgh Courts. Banks is charged with the murder of C. P.

Jones, railway station agent, whose widow, Ella Jones, admitted she had promised to pay Banks $150 if he would frceze out" her husband. Witnesses declared Banks was a frequent visitor to the Jones home, and Mrs. Jones declares he worked tor them and that when she confined to Banks how her husband mistreated her. Banks suggested the "freezing out." Mrs. Jones, who insisted on the witness stand she did not know Banks "meant to kill" Jones, is to be brought to trial Friday morning.

Her part in the case, is concerned with an alleged offer of ICO to Banks to "freeze out" Jones. The prosecution produced no eyewitness of the killing." Banks denied the alleged agreement to which Mrs. Jones testified and generally refuted testimony gf other witnesses, one of whom claimed to have traded bim a shotgun like the one found broken near the scene of the killing.
