In ruling against the construction of the school. Judge Warllck stated that the Board of Education could not legally build a school for their children and "others similarly situat Court ruling.

The suit was originally brought by the parents because there is no school in Old Fort for Negroes. They contended that this was in violation of "equal educational rights."
