The defense is trying to prove Gacy innocent by reason of insanity while the state says the murders were premeditated and is seeking the death penalty. Several times, Rignall, speaking slowly and hesitatingly, collapsed in violent sobs under questioning by defense attorney Sam Amirante. Brief recesses were taken until he could regain composure.

Rignall, now of Louisville, who has published a book about his experiences with Gacy, said he had been under daily psychiatric treatment since the incident. Rignall told of being on his way to a Chfcago homosexual bar the night of March 21, 1978, when he saw a man he now knows as Gacy in a parked car. He said they struck up a conversation and he was told to get in the car. He said Gacy lit a "joint" of marijuana, passed it to him and after several puffs, "I was hit in the face by a dish cloth or a rag it had a cold feeling and I had a buzzing bee in my head and I went unconscious." Rignall said that at times, when he regained consciousness, he was hit again with the rag, which allegedly contained chloroform.
