Hergonson told Diaz he could not honor such a request, but instead offered to provide authorities with Spanish transcripts of everything said on the air. Since then, the authorities have not responded, but Diaz has had previous problems with the Mexican government (several years earlier, a powerful Mexican labor union had forced all three of Diaz's stations off the air for several months in a labor dispute). Diaz said he felt there would be less chance of any further trouble if he himself were in control of the station.

General manager Bruce Walton, however, said he feels Diaz's major complaint was that he wasn't making enough money under the lease agreement, which called for San Diego Radio to pay him a flat monthly rate (how much, he won't divulge), and that the "mole people" incident was an excuse to break the contract more than anything else. "Almost immediately after the signing of the contract on Aug. 1 of last year (Z90 had previously been a Spanish -language station with the call letters XHIS), Victor Diaz began demanding more money from us outside of what was in the contract," Walton said. Diaz, who lives in La Jolla, said the reasons he took back the station are chiefly its poor showing in recent Arbitron ratings books (the station scored anemic 1.2 and 1.6 percentage shares of overall listenership in the two most recent three -month ratings periods, as opposed to rival KGB-FM's 7.6 and 7.9) and San Diego Radio's insistence on referring to the station, on the air, as emanating from San Diego rather than Baja California, which doesn't rest well with the Mexican government's SCT, its counterpart to the FCC.

"We had many other disagreements with them, too," Diaz said. "We want to do a professional job, and we will, as soon as we find people who can do it." And then, there's the infamous "mole people" incident, which Diaz said was the spark that prompted his action on Saturday. On his June 8 morning show, Z90 deejay Bill Hergonson, also the late station's program director, read a humorous Copley News-owned Wireless Flash report that a tequila-drinking German anthropologist claimed to have discovered a tribe of "mole people" living in the sewers of Mexico City. That item went by, apparently unnoticed, but when Hergonson repeated parts of the broadcast two weeks later, Diaz received a complaint from Mexican authorities who were outraged over an apparently racist second-hand account they had been given of the broadcast. The account implied that the people of Mexico are so poor they have to live in the sewer.
