"WE WILL STICK FREEZES OVER Washington Speech of Scottsboro Attorney Bares Alabama's Attempt to Smother Constitutional Rights Of Alabama Case Defendants.

By MANUEL R. ROQUE WASHINGTON, May 4 Samuel S. Leibowita, famous New York attorney for the Scottsboro defense and champion of the downtrodden and oppressed, Sunday came to Washington, and, like Caesar, he saw, he said, and he conquered! Speaking from the rostrum of the Asbury Methodist EDlscoDal Church here, under they auspice of the Civil Liberties League, newly formed branch of th Elks, the famous attorney drove one thousand mixed bearers to a clearer and fuller understanding of the brasea bigotry aad prejudice surrounding the trial and conviction of Heywood Patterson, first of seven Negro youths re trier for aa alleged attack on two white girls near Scottsboro, two year ago. Pointing aa accusing finger to the South, Leibowitx said: 1. they have a thimbleful of brain in their cianlum down there, they should realise that they have a united world against them.

Everybody knows North and South and it and West just what will becon. of th case when It reaches the Supreme Court again. We've got them, and they know itl A constitutional point of law got th It has them worried Our fight for the frnedom of the oppressed will won if we have to flght until hell freezes over!" Lelbowitz said that there is no racial, political, or fraternal pressure behind him to fight for the freedom Of the doomed youths, but merely an opportunity to serve not only the colored people an opportunity to be of service to all the downtrodden people of the world. "I took the case up," he said, "aiter I was aproached by a com 'ttee trom the International Labor Defense, and after being apprised through the newspapers of the of those boys. There was no money involved.

The people who asked me to take Up the case admitted that they were broke that they could not pay. I told them that money would not enter into the question at all, as long as the gave me free rein in the matter, but not before admitting to them that I was a Democrat a Roosevelt Democrat. "Under those circumstances, ladi and gentlemen, I eatered the case. Ty friends told me that I was a fool to take the case, that no man would have a chance de fen a Negro in the South. But I saw in the case an outrageous desire to railroad those boys to the electric chair.

That's why I am here today; to tell you of my consuming desire to see that those boys get a fair and imparUal trial, and I will see that they get ltl cial justice must triumph over blind bigotry and murderous prejudice!" Here Lelbowltz related of how easy It had been to prove that no Negro had ever beea selected to jury duty, despite the fact that It was proven conclusively that Negroes in Alabama ara in every respect qualified to serve on juries. He said that in the course of bis investigation he found lawyers, doctors, professional and business men, all Negroes, who had never been asked to perform and exercise their constitutional rights in the Jury box. The highlight In Lelbowltz's address came when he said to the jwspapermen to be sure to make it a matter of record his encounter with Thomas E. Knight prosecuting attorney, and son of the Attorney General of Alabama, the night before the tilal. "I met him one night," said Leib owltz, "and thie Is what he said to me: the prosecution attorney said, Vou can try this case any way you like.

You cm try it to suit yourself; try them (meaning the boys) any way you like one at a time, singly, or In "What are the conditions?" Leib owitz said he asked. "Just let's try this case and forget the constitutional questions in volved," was Knight's proposition. accoraing io L.eiDowitx, "I will forget this when hell freezes over!" was LeibowiU'a retort, and the case went straight to trial the following day. "It took a lot of courage to flght those crowds, to restrain oneself," continued Leibowitz. Knight is a Southerner, and I can well understand the pressure that was brought to bear on a man who was asked to sit a Negro on a Jury with white men.

But on the other side we have George W. Chamlee, son of a Confederate soldier, defending the rights of a Negro. "I well remember that moment when the Jury came back with the verdict. There they were laughing and playing and joking as If they were going to a burlesque show, yet in their hands ivas the verdict condemning a man to die! "Then human restraint knew no mora! "And still they say that they doa't hav frog eyes, lantern Jaws and llits for mouths full of tobacco Juice; that Jew money from New York was a millstone around that boy's neck! "Now they ar trying to get me out of this ease, but they won't get this Jew from the sidewalks of New. Xork, Not until hell fxeezee here as a suspect.

According to peopl ia the community there had been bad blood between th two men. Button states that he only shot Watson after he advanced upon him with a shovel and threatened his life. He claims that Watson drove up and told him that he had came there to "give him a good beating." "After I had shot" Sutton said, "Watson menaged to wreetle the gun from me and fired two shots at me as I fled." Officers are inclined to believe Sutton's story. over! We've got them, and they know It!" Referring to the Negro's plight, he said, "You can kick a dog around, but some day he will come back to the kennel, and then let the master beware! The South is sitting on a mountain of T. N.

T. They have put a collar around so tight until the black man can't stand It any longer And when the black man turns around let his tormentera beware! "They will never dare electrocute Patterson, and they know it! Ami that is because they know the whole world the civilized world watching. America On Trial "Mark you!" he added. "No violence is necessary. We can do it through the courts.

The Ice has been broken. This is not the fight of the Negro. This is th fight of America a fight to determine whether or not the American flag should fly down there! Thi sis a fight to determine whether or not justice and our Constitution shall 11 or perish. This is a fight against hypocrisy, bigotry and un Amerlcanism a flght to end damnable injustice!" Leibowitx arrived here Sunday morning by air from New Yorlc He gave a talk oa legal points to the law class at Howard University and there he cam to tfce church, accompanied by J. Finley Wilson, grand exalted ruler ot the Elks organization.

Perry W. Howard, legal adviser of the fraternity, said that the movement of the Civil Liberties League is purely a patriotic one. "We are for the Constitution," he said, and will defend tne flag. We are organizing to root out Communism from the heart and breast the Americr Negro. We will uphold the law Of the land." Howard was master of ceremonies.

Earleen Luckett, brilliant student at Dunbar High School, delivered the initial address, in which she outlined the history of the Scottsboro case and urged all her hearers to rally to the aid of the doomed youths. Eight points comprise the program ol the new organisation: (1) To protest the rights of the Negro throughout the United States; (2) To opose segregation and ren service to the race; (31 To make the Negro secure in the exercise of the ballot; (4) To safeguard the life and lib Mm Utrr feat ted, kstross fa 15 nlaatei this qaick Freaca rxy Of eoaxse maa fall lor the aood black hair Bat ot worry If ranlaa; grar.
