They also feared that the requirement to keep Shoney's Big Boy restaurants within their 11-state Southeastern region would stunt the company's growth. In 1980, Spoleta began mapping a strategy to add Shoney's coffee shops outside of its franchise area and to prepare for the lawsuit they expected the move to trigger. New restaurants, known as Shoney's Towne and Country, were opened without any sign of the Big Boy trademark. At the same time, the company de-emphasized the Big Boy symbol and hamburger when it redesigned its existing restaurants and revised menus.

Shoney's executives said playing down the Big Boy affiliation, however, was a matter of changing with the times rather than out of concern of violating a franchise agreement. And company executives are particularly happy about the marketing message getting across to the public in the Atlanta area. That is so because the local franchisee, Atlanta Big Boy Management has consistently outperformed company-owned res-'taurants and has led all of the franchises in sales per restaurant. For instance, in the second week of May, the 20 Atlanta-area franchises averaged sales of $33,820. Spoleta, Shoney's president and chief operating officer, dismissed the possibility that the area's strong economy has boosted sales of the local franchise, noting there is also intense competition among restaurants in the Atlanta area. Instead, he lauded Atlanta Big Boy Management President Sam Ingram for paying close attention to restaurant quality and for trying new ideas. Ingram, for instance, was the first to offer the breakfast food bars that have come to be one of the leading attractions at Shoney's restaurants. He said Ingram, who started at Shoney's as a dishwasher, is "the closest facsimile to (Shoney's Chairman) Ray Danner that I've ever seen."
