THE ATLAMA COSSTITUTJOX, Aug. 9, 1972 House Unit Backs Curb VVv On Busing Pamper Yourself with Savings on Fine Quality nderwear lililliiililf iiiwfciilli isl WASHINGTON (UPI) -A House committee Tuesday approved President Nixon's bill to restrict court-ordered school busing and a full House vote on the measure appeared certain early next week. The bill, one of two antibus-ing bills Nixon sent Congress last March, would set guidelines for desegregating schools with busing as a last resort. Cross-town busing of grade school pupils would be banned under any circumstance. The Education and Labor Committee voted 21 to 16 for the bill which would also set aside $500 million a year for two years to improve so-called "inferior" schools.

The money would come from the $1 billion a year already authorized in law to help schools pay the costs of desegregation. The House Rules Committee, meantime, meeting to consider the second Nixon measure that would order a moratorium on any new court ordered busing, said it would take up both the guidelines bill on Thursday with a goal of sending one or both of the bills to the floor for a vote early next week. The rules panel, a week ago, took from the Judiciary Committee a long-stalled constitutional amendment to ban racial busing and ordered that to the floor. Chairman William Colmer, said he was "inclined" not to call up the amendment until the guidelines and moratorium measures were disposed of in the Housei Nixon has urged Congress to first consider his moratorium bill which would ban new busing orders until July 1 or until enactment of his guidelines measure. He said immediate action was needed to stop "excessive" busing before the start of school next month.

The House is expected to approve one or both of the Nixon measures, depending on how they come to the floor from the Rules Committee. Their fate in the Senate, however, was less certain. The suit, filed by Atlantan J.E. (Billy) Mc Kinney, charges that county property tax levies are disparate and result in varying educational benefits in different counties. McKinney's suit followed by two weeks a suit filed by rural Whitfield County board of education members, parents of school children and taxpayers seeking a restructuring of public education financing in Georgia.

The Whitfield County suit, also filed in federal court, asked for a larger share of the public education dollar for poor counites which are forced to offer inferior educations because they have low property tax bases. A California Supreme Court ruling recently erased property tax advantages for school systems in that state on grounds that wealth may not dictate public education op portunity. The U.S. Supreme Court has agreed to hear a similar case from Texas this fall. "Only rarely and by coincidence," McKinney's suit says, do "the children of one county receive an equal amount for their educational benefits as do the children of any other county." The suit contends that "the discriminatory application of taxing authority as among the various counties, with its re-, sultant disparate treatment of Children, is a denial" of the equal protection clause of the 14th Amendment.

The suit, which names the State of Georgia as defendant, seeks a restraining order and injunction against application of Georgia laws permitting counties to levy property taxes for education. McKinney's brief, two-page complaint was filed Monday. McKinney was on Tuesday's ballot for the Democratic nomination to the 35th District State House of Representatives seat. He is a former Atlanta policeman. them nullified if they did not conform with the provisions of the new guidelines measure.

The reopening clause, strongly backed by Southerners where the bulk of court-ordered desegregation has occurred, is expected to be restored to the bill when it comes to the floor. Any desegregation order, no matter how old or whether it involved busing, could be reopened. "We are shocked and bewildered to be branded as criminals for our revolutionary activities and to see our successful (hijacking) threatened with ultimate defeat by the Algerian government," the letter said.
