He also acknowledged that certain circumstantial evidence offered by the prosecution did belong to him. But he repeatedly denied planning or committing the murders, and in the end made the statement to the jury, which Lang claimed was a surprise to him. Another witness was Walter Searcy, who was escorted into the courtroom wearing the garb of a state prison inmate. Searcy, who said he was serving 15 years for armed robbery, testified that he had worked at the clothing store into which Ward came.

Questioned by Ward's attorney, Assistant Public Defender Ed Lang, Searcy said he had read of Ward's plight, thought he could testify he Sunday changed his mind. Lang got a positive answer when he asked Searcy if he had not wanted to testify because of "apprehension and fear," but the exchange was ruled improper and struck from the record. As he left, the courtroom, Searcy whispered to Ward, "Good luck, boy." Ward himself, after direct examination by Lang, answered prosecutor Leipold's questions in a calm but subdued manner.
