Ho has been using Wntor from Pinal crook for irri gating purposes, the land having been lesed to vegetablo growers. In his complaint, Abcruathy claims, that on -July 13, 1900, after having used water from Pinnl creek for irrigating purposes for two years, ho mado a formal water light filing, claiming 100 leased to vegetablo growers. This water he conducted to his land by menns of a ditch. For somo tinm past, however, he claims that his irrigating ditches have- been cut and the water diverted by tho defendants, occurences of this kind having been fie-quent.

Abornathy asks that the court issuo a writ of injunction against tho defend ants, enjoining them from appropriating any of the water to which he lays claim. Attorney Norman J.
