Aiton "knowingly and willfully published in tho Arizona Gazette, an advertisement" which contained tho testimonials of Miss Ruby, W. B. White of Mnycr, .7. E. Smidt, Mrs.

W. A. Bran-or and Ora Smith of Prescott." The af-fidnvit further avers that the advertisement was published "for tho purpose of soliciting nnd procuring by wrongful and fraudulent methods pa ticnts, and that certain statements were false, and that Dr. Aaiton knew them to be false, and, that they were pub lished for the purpose of deceiving the public." Tho affidavit was not read at tho meeting. Dr.

Aiton made a statement before thi; boanl in which ho denied the charges in every part'cular and asked that other evidence be presented be-foro action was taken In tho matter. No evidence other the affidavit was offered, and l5r. Aiton asked that the action bo dismitscd. Judge Baker who appeared as counsel for Dr. Aiton, in behalf of his client cited the law and decision, which ho sa'd were to tho effect that section 7 of the medical practice regulations in Arizona was void, as that section conferred no power to revoke licenses, as it does not specify "what is unprofessional conduct." Ho referred to the dpqisions in tho California supremo court, in which It was held that such a law was invalid, because it did not defino unprofcsssional conduct.

He ilo cited a decision of tho supreme court of the District of Columbia of similar import. Tho board decided at tho conclusion of the meeting to refer the case to Attorney General Clnrk for opin ion of the law and tho power delegated to the board. Dr. Aiton was very anxious that the case bo made public and that all tho facts obtainablo be brought to light. Judge Baker was disposed to call tho caso a fiasco.

Dr. Aiton camo hero from California several months ago and opened up a business oflico on West Adams streetJ and the company he represents has had quite an extensive patronage.
