Rosobcrry, who has beon held at tho county jail since Inst Wednesday on tho chargo of forgery, is out of his trouble. He had forged the namo of his brother, assistant roadmastcr of tho S. F. to a check for $50, which ho had cashed at tho Anhcuser saloon, says the Phoenix Republican. Rosobcrry had been drinking for somo timo and it was generally regarded that ho was not responsible for tho act.

Thero was no disposition on tho part of anyone to prosecute him, and it was bolieved that his brother would arrange tho matter as soon as ho could bo communicated with. For this reason the case was not hurriedly pushed to preliminary trial. Yesterday morning the brother came to town and sent word to M. L. Vieux, tho proprietor of tho Anhcuser, thnt he was ready to mako the check good.

Mr. Vieux called on Justico Johnstone, out of whoso court tho warrant had been issued, to sco if tho complaint could not be dismissed, Tho court hnd no ob jection, but referred Mr. Vieux to District Attornoy Bullnrd, who gave his consent for the dismissal on tho payment of the costs, which amounted to Mr. Vieux wns paid his money, the costs wero satisfied and an order was sent to jail for tho release of Rose-borry. It was thought aftor all that though this wap rather heroic treatment, that ho was all tho better for it.

"The Board shall fill all vacancies in its own membership in any ofllco, and shall prescribe tho duties of all officers. Article Sovonth of tho Articles of incorporation wns amended so ns to read as follows: "Soventh: Tho highest amount of indebtedness to which this corporation shall at any timo subject itself shall bo Fifty Thousand ($50,000.00) Dollars." Clause Fourth of Articlo Ninth of said Articles was amended so as to read as follows: "Fourth: To render tho shnrcs and interests of stockholders transfo--ablo and to prescribe the mode of making such transfers, and to limit and restrict tho negotiability of such shares." Articlo Eleventh of said Articles of Incorporation was amended so as to read as follows: "Eleventh: Thcso Articles of Incorporation may bo amended, altered and changed with refcrenco to any matter herein set forth oy the alfirmativo voto of a majority of tho stock of this corporation, at any regular annual meeting of tho stockholders or adjournment thereof, or at any special meeting of stockholders called for that purpose" And the President and Secretary of said corporation were, by resolution of said stockholders and stock, duly authorized and directed to take such stops as are required by law-to give effect to said amendments.

Wherefore, tho undersigned, as such President and Secretary, do hereby execute, acknowledge, file, record and publish this instrument, ns required by Par. 770 (Sec. 10) of Chapter II of Titlo XIII of tho Revised Statutes of Arizona, as amended by Sec. 2 of Act No. 8S of the Twenty Second Legislative Assembly of the Territory of Arizona, approved 'March 19th, 1903, and all legislation supplemental thereto and amendatory thereof.
