In Its report on "Lawlessness in Law made public today. cites several Indiana Instances of irregularities tn police administration and judicial procedure in that state. The first Is contained In the chapter on The Third Degree." The report reads: A passenger taken from a train, at Pt.

Wayne. Ind, under a charge of receiving stolen goods, was beaten at the Jail by a city policeman and two private railway policemen commissioned by public authority Further along, the report, discussing types of unfairness in prosecutions, cites this Instance: "In an Indiana prosecution for rape of a young girl the defendant, who was eighteen and mentally subnormal, was advised by his employer and the constable to plead guilty. He did so. unrepresented by counsel. The Judge put him on the stand, asked him many questions about the crime, made no of er to appoint counsel, and told him the an attorney would do him no good.

A life sentence was then Imposed. Judgment was reversed, with leave to plead not guilty and Insanity. Commenting that the danger of improper paroles and pardons sometimes Is urged by prosecutors as reason for heavy sentences, the commission "The district attorney argued in an Indiana murder case that the accused should not be convicted of manslaugh ter. which was punishable by mrpris onment for two to twenty one years, because that meant only two years. 'As you know, he told the Jury, the pardon board turns them out In such cases at the end of two years, and that is not enough punishment in thi case.

A life sentence was affirmed because no proper exception was taken." i Pensions have been granted to In rt lan tans as follows: Sixty dollars. Sherman B. Swart wood. Tab; ISO. Dorsey U.
