STATE OF WISCONSEST, CIRCUIT COURT, OUTAGAMIE COUNTY, ss. 'V't" Mary Rippel, Plaintiff, a 'vvv'vs. Katherine Schilhabel, Nicholas Wolf, and Elizabeth Wolf, his wife, Defen- dants. Notice is hereby given that by virtue of and in pursuance of a judgment of foreclosure and sale rendered in the above entitled action and docketed in the office of the Clerk of the said Circuit Court in and for said Outagamie County, Wisconsin, on the 18th day of June, A. 1904, at 2 o'clock in the afternoon of said, day, I the undersigned Sheriff of said Outagamie County, Wisconsin, will on the 9th day of August, A.

1905, at 10 o'clock in the forenoon of said day, at the Sheriffs office in the court house in the city of, Appleton, in said Outagamie County; Wisconsin, offer for sale and sell at public auction to the highest bidder, all the following real estate and property, or so much thereof as will be sary to satisfy the amount due the plaintiff in said judgment of foreclosure and sale, together with interest. Frightened by the crack of a whip in the hands of the driver of a passing butcher wagon, the horse driven by Theodore Stolt became unmanageable Saturday afternoon at 4 o'clock and dashed through a whole block of back yards, stopping at last only when encountering a thick hedge of berry bushes back of the home of Albert Pasdi. Th'e occupants, Theodore Stolt and his 14-year-old son, of Grand Chute were thrown out and injured. The horse was being driven by Stolt along Superior street, near Commercial, Saturday afternoon when a butcher's wagon passed, and the boy driving gave 'an idle crack in the air with the whip in his hand. The sound was like that of a pistol sh'ot just at the horse's head.

He swerved and dashed to the sidewalk and into the rear of the lot owned by John Bartels, and straight on through the block of rear yards, trampling flower beds and bushes. Mr. Stolt sustained a bad scalp wound, and the boy is at th'e home of William Lueders, 11 58 Appleton street, suffering with a concussion 'of the brain. Both are badly bruised. The light buggy was almost completely demolished and the horse was also hurt.

Lucille Colbert, aged 62 years, of Bear Creek, was found guilty in this city of having set fire to her millinery store in Welcome, causing a "fire which wiped, out the whole village of Welcome causing a loss of $80,000. Elmer Lehr at Fond du Lac Friday night, and expressed his joy at the outcome of the last trial.

Decision was reached at 6 o'clock Friday night, the court stating that judg-ment had been reversed and the case remanded for a new trial. The attorneys for the defense said this morning that they' thought the. case would never again come up for trial. District Attorney. Krugmeier in an interview this afternoon, said: "I see no reason why Mrs.

Colbert should not have another trial. The supreme court has seen fit to remand the case for a new trial. for one, do not see why the trial -should not take place. If it does come up it will be at the next term of court. Because the accused is on old woman, public sympathy, seems to be with her.

That is no reason why there should be an opinion that the case will not again- come up for trial.
