REFUSES 10 REV1EY 51 DAMAGE SUITS Supreme Court Sets Pensions 4 as Federal Liability. LIQUOR APPEAL LOSES WASHINGTON, January 7 (A.P.) The tragedy of the submarine 51 Is not a subject for judicial Inquiry by the United States supreme court. In refusina to review I from lower courts, the highest court' loaay so aeciaea. The 51 was rammed by the steamship City of Rome off Block Island September 25. 1825.

The estates of Lieutenant Rodney H. Dobson. Its commander; Lieutenant James D. Haselden. and Ensign Edmund Egbert sued the government for damages.

They lost in the lower courts, which held the pension law was the limit of the government's liability. The supreme court again refused to pass on the appeal of the Hart Refineries attacking fhe validity of the Montana tax of 2 cents a gallon on gasoline. The court recently dismissed the appeal holding that it did not present a federal question. The refineries insisted that as gasoline broueht into the state in competition with it was nor so taxed it was being subjected to unfair and ruinous competition. Abraham Braunsteln's attack on the New York education law was thrown out of the supreme court.

The court affirmed its order of De cember io dismissing the case for want of a. properly presented federal question. Braunstein asserted that he ra giving his son a nrorjer education at night schools, and that the state could not compel him to send the boy day schooL which Interfere wim nis employment. Liquor Case Review Refused. The government won in a hiir nrn hibltlon case from Seattle, involving uwrveen men wno were convicted of conspiring with sixty four others to violate the prohibition law.

A supreme court review of their conviction was refused Pete Dahl. George Keams and eleven others. They contested the conviction on the ground that the district attorney who prosecutea them stressed their failure to take the witness stand and that accomplices were permitted to testify without instructions from the judge as to the weight such testimony should be given. An attack on the constitutionality of the New York water power act made by Percy A. Horton and others was dismissed by the court on the ground that It presented no federal question.

The attack was aimed at that part of the law which classifies the land which may be taken by condemnation proceedings. Horton insisted that the law was arbitrary, and had the effect of greatly enhancing the value of water power property of one kind while depreciating the value another. The particular provision assailed related to the classification of property at proposed power sites. Zoning Law Suit Fails. The court refused to pass on the validity of the zoning ordinance of Tulsa.
