But what appears to us ftill rrjore extraordinary, is their declining, in their late Nego ciations with your Honour, after they have aTurned the Claim, to profecute it on the Merits beforthis Majefty in Council, the only proper Judicature where this unhappy Controverfyr can; be decided, as this Conduct carries with it the Appearance of a.Defign to delay a Matter, of which the Peace and Tranquility of both Colonies require an immediate Determination, if r.ct to continua their un juflifiable Proceedings in Support of their Claim. Their Water was put into foul Wine Cafks, which turned it four, and occafioned a violent Dyfentery About 80 of their Nusnber died of this Difeafe 5 and, incredible to fay itj there was Six pence Sterling exacted from the Living, for the Liberty of lifting each life lefs Corpfe over the Side, and depofiting it in a watery Grave. In fhort, there appear Circumftances uncommonly favage and brutal jn the Treatment of thefe wretched Paffengers.

The Contractors in Scotland are very highly cenfured but their miferable Manner cf victualling the VefTel could hardly he accompanied with Orders, to treat the poor Folks with Cruelty and infupportable Infolence, Which they loudly complain of. When their forlorn Condition was communicated to the Rev. Dr. Auchmuty, Retor of Trinity, and to the other Clergy of the Church of England, they, laft Sunday, very pathetically reccm snended it to their three leveral Congregations, from whof cordul toe jame in bius of Credit in toe iviznner Dcrem ajter ainciea, ana for providing a Fund for fnking the faid Bills cf Credit, by a Tax on all Efiates real and per tonal, and Taxables lOitbin this Province." Jan. 20. On Satarday, at 4 o'Clock in the Morning, the Brig Nancy, George Smith, Commander, with 'equal. Prudence and Precipitation, took her Departure for Charles Town, South of this Province have proved ineffectual to reftrain thefs lawlefs Difturbers of the Peace within any Bounds, vre have thought it Beceflary to prepare and pafs a Bill with mere fevere Penalties, which we hope will in future deter them from the Execution of their unwarrantable Degns, and reftore the public Tranquility.
