Mr Arnold You stated on the former occasion that you were positive he was the person who brought the letter to your shop and obtained the money, although he was differently dressed. I put the question twice to you, and you stated that you were the more positive upon hearing lnm 8peak. Have you any reason to alter that opinion Do you still positively identify him, or have you any doubt faulkener: I don't seem to have the least doubt.

It having been siateJ that the foreman of Mrs. Faulkener had not arrived, but was expected, Mr. Arnold requested the stranger who had waited upon him, and made the important disclosure above referred to, to stand forward with his son. The latter, a boy younger and less than the aecuBed, and as unlike him in complexion and appearance as any two persons could possibly be, was then sworn, and said My name is Henry Hanker. I was coming across the park when a man came and tapped me on the shoulder. He looked like a gentleman's servant, and said, tan you spare ten minutes? Faulkener's, the butcher's, as he told me. 1 had never sesn her before. She gave me fifteen sovereigns and a half, and a 5 note. I gave him the bag, and he gave me a shilling for my trouble.

He also gave nie a letter to put in the post. Mr. Arnold On what day was it? Witness On Monday three weeks, at about five minutes past five.

Mr. Arnold Do you know anything of the prisoner Witness Nothing whatever I never saw him till now. Mr. imold You have heard the statement of this witness, Mrs. Faulkener? What do you now Bay with respect to the prisoner's identity Faulkener: I went as far as to say I thought it was the boy.

Mr. Arnold Do you say so now Mrs, Faulkener I don't know any difference of the one boy from the other. I'm sure I didn't mean anythiugrong. I'm sure it has disturbed me very much thinking about it. Mr.

Arnold And very properly. I was induced to place every reliance upon the weight of your testimony that this was the boy. Mrs. Faulkener I see now the difference. Mr.

Arnold Can you soy now who brought the cheque Mrs Faulkener: I certainly see the other must be the boy. Mr. Arnold You believe not tne prisoner: iurs. Faulkener Certainly it was only one sight I got of him, as I said. Mr.

Arnold Pardon me, you went a great deal further. I thought you might be labouring under a mistake, because I have known such things occur as that when persons are sent for to see a prisoner, charged with a similar offence to that committed against them, they have erroneously come to the conclusion that, as all the circumstanoes of the case are similar, he must be the person. I therefore, in order that no mistake should affect the prisoner, put question upon question, aud you declared that you had no doubt whatever of his identity, and you were even more positive when you heard him speak. Mrs. Faulkener It was a sort of faltering voice.

Mr. Arnold You have acted most improperly and incau-tinndv nwincr in the facilities eiven bv the public press. the father of the bov, who has given evidence, became acquainted with wha't'has taken place here, and has very properly come forward and exonerated the prisoner whom you identified. Had it not been for the report published of the previous examination, the father of this hoy would have known nothing about what had occurred here. Your testimony would have been unimpeached.

I should have felt it my duty to have committed him, and he would, in all probability, have been convicted and transported. Some witnesses having been called, who 'gave the accused an excellent character, and the police having stated that they had no other charge against him, Mr. Arnold immediately discharged the unfortunate accused, assuring him that he left that court without the slightest imputation upon his character.
