Campbell swears on the basis of information and belief that neither he nor any member of H & B Communications Corporation, nor any of its officers or directors or attorneys at any time received a comrrvunication from the city of Logansport informing us that a final offer must be submitted by April 23, 1 962, the date on which Common Council made a decision favoring one of the Franchise appli cants. For this reason H & B believes that it was deprived of due process in a matter.involving revenue to the city and charges to its citizens, and thatihe city of logansport was deprived of the opportunity to receive the benefits of our superior proposal dated May 4. In view of the controversy surrounding this matter, H & B now concludes that the public interest in Logansport can be served only through the enactment of on enabling ordinance prepared by the Logansport City Attorney for the benefit and protection of .Logansport citizens without influence from, through, or" by any applicant. Sealed, written bids should be-invited from, any and .all applicants. Bids should be opened in the presence of all bidders. The award of a permit to construct and operate a community antefvna system pursuant to the language of i the city's enabling ordinance should be made strictly on the basis of written, sealed bids. We -respectfully urge the Common Council to direct the City Attorney of Logansport to prepare a draft of such an enabling ordinance, to hold public hearings on it and to enact such cm ordinance for the permanent benefit of Logansport. H & B believes the enactment of an enabling ordinance as respectfully suggested herewith to be' the honorable and fair way to resolve the issue. . ._ , JOHN P. CAMPBEU.
