(Present, Lord Cottcnham (presiding), Lord Brougham, and Lord Campbell.) WALLACE V. TATTON. This was an appeal from a decree and order of the Court of Equity and Exchequer iu Ireland, in a suit which was brought there by the respondent to compel the appellant to grant him a renewal of a lease, and to convey to him certain MONEY MARKET CITY NEWS. Thursday Evening. A sort of paralysis would appear to have affected the Stock Market to day.

Speculators and dealers seemed to be equally at fault, or in suspense, about the right or most promising; course to be pursued vnder actual circumstances. The intelligence from the United States lias evidently made a strono- impression. The extent to yvhich it should be Interpreted has been tho difficulty. It may be discerned, however, that the more prevalent tendency of opinion points to war as almost inevitable. In this situation of suspense and expectation, the Stock Market was cpiiesccnt and inactive.

Charles M.Williek, the able actuary of the University Life Assurance Society, to whom the public are already indebted for his valuable annual Tithe Commutation and his Income-tax tables, has just published, in a convenient pamphlet form of a dozen pages, a series of "Popular Tables," for ascertaining at sight the value of advowsons and next presentation to livings, showing also the expectation of life at different ages, with the value of reversions at death and for terms of years, which must prove of more general utility and reference oven than his former productions. He has taken the Carlisle tables of mortality as the basis of his calculations, as now admitted to approach much nearer the truth than those of Northampton, by favour of the peculiar construction of which, in so materially overrating the risk or chances of life, the Equitable Assurance Company has been enabled to accumulate so many millions of surplus profits that the repartition among those entitled, as well as the determination of the knotty point as to the parties entitled to share in the whole mass of capital, has been a cause ef no small perplexity. Other assurance companies of old standing, or more modern creation, which have acted on the same tabular standard, have, in a greater or less degree, also derived the same advantages at, in the case of those ot established on the mutual system, the cost proportionately of the public. The difference betwixt the Northampton and Carlisle tables, so much, for the latter, in fa vnm nf thn lands comprised such lease. The annellant.

Ho then appealed against that order.

Mr. Turner and Mr. Purvis, for the appellant, argued that the decree was erroneous, being in opposition to an agreement between the parties, and that the account ought, under the circumstances, to be again opened, and the appellant let in to dispute various items in it. The first sums, making together were paid, though not at the precise periods at which the different sums were specified to he paid but the 300.

was not paid on the 31st of December, nor by the Sth of January, 1842, to which day the plaintiff extended the time for payment, that being the last day for enrolling the. specification. As it was essential to the interests of the patentees to have the 3002. before the 31st of December, 1841, for the purpose of obtaining the foreign patents, the plaintiff insisted that according to tho aforesaid agreement the time for he payment of the -3002. was of the essence of the contract; and that it not having been paid, the plaintiff was at liberty to put an end to the contract.

The plaintiff accordingly gave formal notice to the defendant on the 11th January, 1S42, that he rescinded the agreement, and was ready to repay to him the various sums of money the defendant had advanced, with interest on the same, and demanded that the defendant should deliver up the letters patent. The defendant having refused to do so, and insisted on his agreement, the plaintiff filed a bill stating the circumstances and praying that the contract might be rescinded, and that the- defendant might deliver up the letters patent. And whereas there is reason to apprehend that many of her Majesty's loyal and peaceable subjects in Ireland have been and may be deterred and intimidated by persuasions, rewards, threats, or promises, from discharging their duty as prosecutors, witnesses, and jurors, upon trial of crimes and offences in the respective counties in which such crimes and offences have been committed; and there is reason to believe that the persons committing such crimes and offences are greatly encouraged in the commission thereof by their hopes of being acquitted if tried by the petty jurors of their respective counties for the more impartial trial of persons offending against the laws now in being and against this act, be it enacted, by the authority aforesaid, that if any indictment or indictments for any misdemeanor or misdemeanors whatsoever committed after the passing of this act shall be found in any county, county of a city, or county of a town in Ireland, it shall and may be lawful for her Majesty's Court of Queen's Bench in Ireland, or in vacation for any two judges of the superior courts of record in Ireland, upon the application of her Majesty's Attornej'-General for Ireland, to make order that the person or persons named in such indictments shall be tried by a jury of the county of Dublin, and that thereupon the person or persons named in such indictment or indictments shall he proceeded against and tried upon such indictment or indictments for such offences before the said Court of Queen's Bench, or before such commissioners of oyer and terminer and general goal delivery as shall Fcrozshuhur, 21st DccemGcr. It was from this decision that the defendant appealed Mr. James Russell and Mr. Jaaies Parker upheld the decree of the Court below. Mr.

Rogers appeared for the defendant, and contended that the plaintiff had waived time as being essential to the contract by the changes he had! permitted; in the days of payment that plaintiff had sustained no loss by the delay, and had no. right, after pencatifing the times of payment to be to suddenly appoint a certain hour for payment, after which the contract was, to, be atan end that the defendant was. desirous of asceraiaaing before he paid his money that the- specification was. sairoBed, or ho might lose his Tho Lord Chancellor said he thought this was an after thought, you must take the contract as it is. If the patent be valuable the party -would be sure to enrol it.

As to what the learned counsel said about the defendant's honesty of intention, that had nothing to do with contract. It has been said that there no evidence to show that any injury had been occasioned: to the plaintiff by the money not being paid before the 8th or 11th of January now a case had been cited, where a party was to insure against fire, and he did not do so according to his contract. There it was irrged that no loss was occasioned but the day was deemed material by the court. It is no answer to say no injury had happened it might have occurred. In this case the Sth of January is deemed a material day for the payment.
