Call in connection With a controversial Albany Hill land transaction, says Charles Herbert, deputy district attorney. His conduct and bis actions were based on advice from the city attorney, Herbert said yesterday; it wouldn't be fair to charge him with a crime when he was following Salers advice since that counsel negates criminal intent, Herbert reasoned. He said he would cohipire statements made to him during his investigation with de-T positions in a pending civil suit seeking to the transaction. If the two correspond, he said, the D.A.s will back out of the matter aiid leave its resolution to the outemne of the suit. He declined to indicate what might happen if they didnt correspond.

Herbert had been investigating the possibility of a conflict of interest on Call's part regarding Call's Nov. 13, 1972, votes when the council approved a multi-million-dol-lar-development on the western base of Albany Hill Call subsequently sold 1.1 acres of his land atop the hill for $258,000 to the developer. Interstate General Pprp. (IGC), which then donjpd it to the city. This donation was part of a package under which the council gave IGC approval Nov.

Fay Roeth, 80 Funeral services have been held for Fay Watson Roeth, wife of George Roeth founder of Housewives' Groce-' teria. Mrs. Roeth died Wednesday at the age of 80. A native of Vacaville, Mrs. Roeth graduated from the Univers of California, Berkeley in 1916 with degree in English.

Mrs. Roeth lived in Piedmont from 1922 to 1966, and moved to Oakland in 1966. She was a member of the Piedmont Community Church and the churchs Women's Guild. She was also a member of the Delta Delta Delta Sorority. Roeth; a pioneer Oakland resident, founded Housewives Groceteria, now Sixth Street Market, in 1914.

He was also owner of the Independent Wholesale 'Grocery Copipany for 30 years. He died Also surviving are a George HI of Fruto, a daughter, Suzanne R.
