Chicago Tribune, Thursday, February 10, 1977 Section 3 11 1 NOVEllO SAATH0FF Obituaries Bid to free accused slayer of child rejected A MOTION TO dismiss charges against Michael Evans, 18, accused the rape-murder of 9-year-old Lisa Cabassa, was denied Wednesday by Judge Frank Barbaro in Criminal Court. Evans' lawyer, Sam Adam, had contended that a trial for Evans would place the defendant in double jeopardy. Evans, who lives at 8611 S. Saginaw was convicted last June 17 of the Jan. 13, 1976, murder of the Cabassa child after she was abducted from 8Cth Street and Saginaw Avenue, near her home.

But Judge Earl E. Strayhorn later granted a new trial on grounds that the state had withheld information from Evans' lawyer. ADAM ARGUED that under a recent U.S. Supreme Court decision, Stray-horn's action amounted to an acquittal, and therefore Evans should be freed. Thomas Green, an assistant State's attorney contended, however that Strny-horn's ruling meant he wanted the case reheard in light of new evidence.

Barbaro also denied a motion by Adam to dismiss the case because of "gross misconduct by the prosecutors." He said he had reviewed the record and that neither he nor Strayhorn found evidence of misconduct by the state's attorney's office. James Davis, 24, and Paul Terry, 18, also face trial in the Cabassa slaying. on Friday and from 10 a.m. to 2 p.m. Saturday.

Surviving are his widow, Rad-mila; a son, Branislav; and a daughter, Dubravka. Henry II. Locff Services for Henry H. Loeff, 92, formerly of Chicago, will be held at 1 p.m. Thursday in the chapel at 111 Skokie Wilmette.

Mr. Loeff died Monday in West Palm Beach, where he lived since his retirement 18 years ago. He was executive vice president of Kling Brothers, a former manufacturer of men's clothing. He is survived by his widow, Esther; two sons, Harold and Ralph; 10 grandchildren, and one-greatgrandchild. Paul A.

Victor Paul A. Victor, 56, of 9335 Landings Lane, Des Plaines, died Wednesday in St. Francis Hospital, Evanston. Mr. Vic- tor worked for more than 30 years as printer for the Commerce Clearing House, 4025 W.

Peterson Av. Surviving are his widow, Faye; a daughter, Mrs. Rochelle Hcnning; a son, Alec; two grandchildren; a brother; and two sisters. Services will be at 1 p.m. Friday in the chapel at 111 Skokie Wilmette.

Judge John S. Hastings Services for Senior Judge John S. Hastings, 78, of the United States Court of Appeals, will be at 11 a.m. Thursday in the Fourth Presbyterian Church, 12G E. Chestnut St.

Burial will be in Washington, Ind. Judge Hastings died Monday in Northwestern Memorial Hospital. He had retired from the 7th Circuit Court of Appeals bench in 1968 but remained active as a senior judge, commuting from his home in Washington, Ind. A West Point graduate and South-em Indiana attorney, he was appointed to the court in 1957 by President Dwight D. Eisenhower.

Judge Hastings held a law degree from Indiana University and served on the university's board of trustees for 23 years, the last eight as president, until 1959. That same year he became chief judge of the Appeals Court, serving in that capacity until reaching mandatory retirement age of 70 in 1968. Surviving are his widow, Esther, and twin sons, William E. and James R. Will County makes plea to murder informant Jerry nttro Jerry Pittro, 53, a machinist who worked for the City of Chicago at O'Hare Airport, died Wednesday in Northwestern Memorial Hospital.

During the Pittro was a boxer known as Baby Galento end had one unsuccessful fight with former middleweight champion Rocky Gra-ziano. He is survived by his widow, Rose; a son, Gerald; and a daughter, Mrs. Kalhy Gagliardo. Mass will be at 10 a.m. Saturday in St.

Gertrude's Catholic Church, 9613 Schiller Franklin Park. Dr. Robert J. Overstreet Dr. Robert J.

Overstreet, 50, a staff physician at Presbyterian-St. Luke's Hospital and assistant professor at Rush Medical College, died Wednesday at the hospital. Dr. Overstreet, of 45 E. Division was appointed to the surgery staff of St.

Luke's Hospital in 1958 and became a staff physician at Presbyterian-St. Luke's when the hospitals merged the following year. Memorial services will be at 4 p.m. Monday in the Blair Chapel of the Fourth Presbyterian Church, 126 E. Chestnut St.

F. Walter Hollenslcuicr F. Walter Hollensteiner, 73, a retired vice president of the Draper Kramer, Ino, real estate firm, died Wednesday in Presbyterian-St Luke's Hospital. Mr. Hollensteiner, who lived at 5903 N.

Kost-ner retired in 1968 as manager of Draper Kramer's North Side office after 40 years with the firm. He was a past president of the North Side Board of Realtors and North Town Kiwanis Club. An authority on the history of Northwest Montana, he was a frequent contributor of articles to the Montana Historical- Society. Surviving are his widow, Dorothy; two sons, James and Walter; seven grandchildren; and two sisters. Services will be at 3 p.m.

Friday in the chapel at 6150 N. Cicero Av. Zivojin Lakic Zlvojin Lakic, 52, Yugoslav consul general in Chicago, died Tuesday in Anderson Hospital, Houston, Tex. Mr. Lakic, a former ambassador to Tanzania, had been consul here since August, 1972.

He was a graduate of the University of Belgrade Law Faculty in 1935 and served as a captain in the Yugoslav army during World War II. A condolence book will be in the Yugolslav consulate, 307 N. Michigan Av.f from 10 a.m. to 2 p.m. and from 3 p.m.
