His defense took less ttiaiv.a day and was made up largely of character witnesses. Sweig's lawyer, Paul T. Smith of Boston, said that while Voloshen was guilty of influence peddling, there was no evidence to connect Sweig with Voloshen's schemes.

Smith pictured Sweig as a man who had been In government service for 24 years and would not have betrayed McCormack. He stressed there "isn't one bit of evidence that Sweig got a dime." The lawyer said Voloshen had been using the Speaker's office, long before Sweig became McCor-mack's chief aide and he added that one of the functions of a congressional office was "to do favors for people." The quiet-spoken but forceful lawyer told the jury it was not their function to decide whether it was fair for congressmen and their aides to do favors for lawyers. "We are here not as an ethics committee," he said in summation. Get a Cool Start (or Summer! The defendant, who sat quietly throughout the trial, did not take the witness stand. Originally, Sweig was charged with conspiring to defraud the government and with nine counts of perjury in connection with testimony before a grand jury.

Judge Frankel dropped three of the perjury counts. Seymour said in his summation that Sweig made calls to federal agencies on behalf of such specific clients of Voloshen as the Parvin-Dohrmann Co. of Los Angeles, and Edward Gilbert of New York. Voloshen received $50,000 rom Parvin Dohrmann for services rendered in connection with arranging a meeting with Budge, the SEC's chairman. At that, time stock of the concern which operates three Las Vegas casinos and a resturant supply business was suspended.

The defense was based primarily on the contention that Sweig's actions, if true, were the accepted lie of Do en's Sell for More Elsevlicre! The government had sought to picture Sweig, 46, as a man who betrayed his chief. Before deliberations began Wednesday afternoon, U.S.

Atty. Whitney North Seymour Jr. told the jury Sweig had made at least GO telephone calls to a host of government agencies on behalf of clients brought to him by Nathan Voloshen, 72, the Speaker's close friend for over 20 years. rieaded Guilty Voloshen, a New York and Washington lobbyist who was indicted with Sweig in January, pleaded guilty at the opening of the trial to conspiring to use McCormack's office as a base for influence peddling to defraud the government and to perjury charges. He could face 20 years in prison and $16,000 in fines.

He will be sentenced Sept. 17. Voloshen did not appear as a witness. The 7S-year-old McCormack, who announced he would retire from the House at the end of the year, did not face any charges. He suspended Sweig when the government's investigation became known last year.

Seymour told the jury that Sweig and Voloshen used the power and prestige of the Speaker's office to earn at least $169,000 between 1964 and 1969. Sweig was described as Voloshen's "partner" but the federal prosecutor did not accuse him of sharing in the money. "It was Martin Sweig who made the contacts and opened the doors to public agencies and exerted the influence of the Speaker's office for Voloshen's clients," Seymour told a crowded courtroom. He called the influence peddling "the worst kind of morality." Witnesses testified during the trial that Voloshen was paid fees by several large corporations, convicts and a soldier seeking discharge from the Army. The government called 47 witnesses to back up charges Sweig made phone calls at Voloshen's request to such federal agencies as the Securities and Exchange Commission, the Defense Department, the Labor Department and the Selective Service System.

In his testimony last week, McCormack denied he knew Voloshen was using his office extensively to seek favors for clients. He said he knew that Voloshen and a business partner, John Donato, who testified for the prosecution, represented people in Washington. But McCormack said he never pressed them for details. "I'm not an inquiring fellow. I never ask people what their business is," the Speaker testified.
