The restraining order was upheld by the State District Court of Appeal which declared that the city, in order to condemn the property, must name as defendants all owners of lots in the subdivision and would have to pay damages to every lot owner In the tract. The appellants declare in their petition to the Supreme Court, that unless they are allowed the right to appropriate such property as is needed for streets in the regular way, that the highway system of the State will be paralyzed. This point has never been tested before In a State court and the decision will have a far-reaching eftect on thousands of pieces of land carrying deed restrictions throughout California.
