Mr. Horn submitted the plan as proposed by the railroad company and it will be submitted the council committee to the city council next Wednesday night. The plan IP to proceed at once with the construction of a temporary wooden trestle across the viaduct, the company to defray one- third of the expense of excavation. The proposition submitted to Mr. Horn by the committee some weeks ago was either to put in a steel euspen- sion bridge, and to pay one-thud of tne excavation; or a temporary structure, and to pay two-thirds of the excavation expense.

It was explained yesterday by Mr. Horn that the company desired to sro ahead at unce i the temporary structure and to later put in the steel bridge. The committee is almost unanimously in favor of this plan and it is believed the council will adopt a report favoring the temporary structure, in order that work may-begin at once and be finished before the race meetinst orenr. The plan is to lower the grade of Harrison avenue in South Butte so that wagons may pass under the Northern Pacific track at the entrance to the lane that leads from South Butte out to the Hat. This point in the railroad yards is a dangerous place for teams and street carr.

He threatened to kill her and she believes he 'would have done it if she had not left him and come to Montana. In an affidavit for the publication of summons she says the defendant is still living in New York.
