Slayings Could Bring Death Penalty Continued from 8th Page White, whose full name is Daniel James White, is scheduled for arraignment today on two counts of first-degree murder, The complaint filed by Freitas charged that White used a revolver in Monday's murders of Moscone and Milk. It alleged further that "special circumstances" existed in the crimethe murder of more than one person the the murders of officials in retaliation for performing their duties, If a jury convicts White and agrees those special circumstances existed, it could impose the death penalty. But if it finds that, mitigating factors outweighed aggravating factors in the case, it could impose life without parole.

However, those provisions, like the rest of the law voted in under Proposition 7, await constitutional tests from the courts that take years. Freitas announced the filing of the murder complaint against White af a crowded news conference in his third-floor offices in the Hall of Justice here Tuesday afternoon. But the district attorney did not say whether he would seek the death penalty at the time of the trial and declined to answer questions about the case, indicating he wished to avoid pretrial comment that would prejudice White's rights as a defendant. "The case will unfold in court," Freitas said. "Eventually the public will be entitled to know every aspect of the case." Moscone and Milk were gunned down in their City Hall offices Monday less tl -n an hour before the mayor had scheduled a press conference to announce White's successor. White intly had become distraught over not being reappointed an people who know said, if anything, he might commit suicide rather than commit violence against someone else. "He went through a few months of very hard work, financial problems and a new baby," said Dianne Feinstein, president of the Board of Supervisors, who became acting mayor upon Monscone's dea'h. "It had triggered a sense of hopelessness," she said. And a Moscne aide who knew White said the accused former supervisor "couldn't separate politics from personal things.

He was very much an amateur in that. He couldn't understand how anyone could take political defeat and not have it bouier them." White reportedly gained entrance to City Hall by crawling through a basement window after telling a building engineer who he was and explaining that he had misplaced his keys, it was disclosed Tuesday. He apparently ustu ihe window to bypass a metal detector at this main building entrance, although police officials said Monday supervisors or recent supervisors rarely are screened when they enter the building. They are allowed to simply walk around the detector. White had no appointment with the mayor, but asked to see him and Moscone agreed to the meeting.

A preliminary autopsy report released Tuesday by San Francisco Coroner Boyd Stephens indicated the mayor, 49, had been struck by four bullets causing two wounds in the head and two in the chest and abdomen. Stephens said the head wounds produced "severe damage" to the base of the brain. The report also said that Milk, 48, had been struck five times twice in the hr-ad, once through the right arm by a bullet that then reentered the abdomen, once by a bullet that entered the left chest and then the left arm and once in the back. Milk's head wound produced "severe damage," according to the corona report. Stephens also said that the wounds suffered by both victims had caused "instantaneous death." The fact that at least nine shots were fired indicated that the gurjnan had to take lime somewhere between the shooting of the two men to reload.

White turned over to police a Smith Wesson revolver when he surrendered at a police substation not far from City Hall less than an hour after the shootings. Moscone and Milk will be honored at noon today with a memorial service outside City Hall at which Mrs. Feinstein, Lt. Gov. Mervyn M.

Dymally, Albert Latin, a friend of the mayor's, and Ann Kronenberg, a staff aide to Milk, will deliver eulogies. A section of the San Francisco Symphony will provide music.
