The court denied Gibraltar's petition for an order barring Kemper from buying any more Gibraltar stock until a hearing has been held by state authorities to review a Jan. 12 decision permitting Kemper to buy up to 25 of the stock. A date for the hearing has not been set.

"We will proceed now with the hearing before the savings and loan commissioner," said Arthur W. Schmutz, attorney representing Gibraltar. State Savings Loan Commissioner Saul Perlis authorized Kemper to increase its holdings of Gibraltar to 25 from just under 10, but his ruling is subject to review if either party requests a hearing. Schmutz said Thursday that the hearing date will not be set until schedules have been arranged for witnesses, but it should be "within the next four to six weeks at the outside." Kemper has said that its acquisition of Gibraltar's stock has been for investment purposes only. Officials of Gibraltar the parent company of Gibraltar Savings Loan have contended that Kemper is attempting a "a non-negotiated takeover" of Southern California Options Society presents the committee.

Federal Reserve Chairman G. William Miller told the panel on Tuesday that levying surcharges would be a possible response to the weakening of the dollar overseas. Miller expressed confidence that he didn't believe such a step would be necessary, however. Blumenthal told the committee he thought the Administration would give "sympathetic consideration" to a proposal to permit higher interest payments on small, individual savings accounts. But he qualified his answer by saying he hadn't had time to look thoroughly into the question.

New orders for durable goods in December increased slightly by $200 million, or 0.2, to a total of $76.8 billion. The nonferrous metal industry reported gains of $700 million, or 15.4. to $5 billion.

There was a decline in orders in the transportation equipment industry of $1.6 billion, or 7.5, to $19.3 billion, with most of the drop occurring in the aircraft industry. New orders for nondefense capital goods declined 7.4 in November. Household durable goods industries registered increases in orders of $300 million, or 6.1 to $4.6 billion. The Canadian currency fell as low as 83.30 cents at one point Wednesday before the Bank of Canada stepped in with what traders in Toronto called "substantial" intervention.

New York traders attributed the Canadian dollar's weakness primarily to end-of-the-month transactions by Canadian companies, which are buying U.S. dollars so they can pay dividends and make other remittances to their American parent firms. In Ottawa, meanwhile, Canadian Prime Minister Pierre Trudeau told the House of Commons that the "policy of the government since 1970 was to have a floating dollar, and that the value of the dollar is established by the market system operating in the normal way." In Tokyo Wednesday, the dollar rose to 201.425 yen, its highest close on the Japanese market since it hit 202.05 yen last July 20. The dollar had closed at 200.325 yen in Tokyo Tuesday. The dollar continued rising in New York Wednesday after the Tokyo exchange closed, finishing the day at 201.87 yen, up from Tuesday's 201.30.

Other late dollar rates overseas included: Frankfurt, 1.8642 West German marks, up from 1.8615; Zurich, 1.69825 Swiss francs, up from 1.68795; Paris, 4.28025 French francs, up from 4.2725; Amsterdam, 2.0140 Dutch guilders, up from 2.0090; and Milan, 841 Italian lire, up from 840.80.
