He recently filed nomination papers and paid filing fees to run for the City Council in the April 5 municipal election. His lawsuit names as defendants the entire City Council and several other city officers, including City Clerk Florence Malone. According to the complaint, Vogl was informed by the city clerk that his Personnel Board seat must be declared vacant as a result of his candidacy. Vogl's lawsuit, however, alleges that no similar provision exists for other civic bodies, such as the Museum Board, Library Committee, Parks and Recreation Commission, Planning Commission, Human Relations Commission or Transportation Advisory Commission. The complaint names three attorneys Alan Curtis, Michael Leverson and Fred Munoz as others who share similar civic posts with Vogl and join in the lawsuit as "friends of the court." The charter section involving the Personnel Board states: "None of the members shall hold public office or employment or be a candidate for any other public office Vogl's lawsuit alleges that the wording is unconstitutional, is being wrongfully interpreted by the defendants and discriminatory.

The complaint seeks a writ of mandate permitting Vogl to retain his board seat while running for the City Council. Authorities said testing continues to yield negative results and would have been abandoned years ago if it had not been for political pressure. One person who should have data is Dr. Ernesto Contre-ras, a former Mexican army pathologist who operates one of the two clinics in Tijuana that treat about 2,000 patients a year.

McNaughton, who set Contreras up in an office about 12 years ago, said the results of seven years of trials on humans were sent to the FDA. But Paul Sage of the FDA's litigation unit said only "about a dozen of Contreras' best cases" were received. He said in eight of those cases in which the patients were still living, American investigators examined all records.
