The station's original 18-month construction permit, which it won after a seven-year application battle against five other contestants, expired Friday. The permit is held by Golden Orange Broadcasting Co.

Int, headed by singer Pat Boone. A major stumbling block in launching the station, according to its attorney, William G. Simon, has been the transmitter site on Sierra Peak above the Santa Ana River canyoa All six applicants for the permit proposed using the same site, Simon explained, but after Golden Orange won, it discovered the proposed transmitter site cant adequately serve Orange In its application for extension of the permit, Golden Orange said it has made an agreement with Orange County's education television station, KOCE-TV, Channel 50, to discuss sharing that station's transmitter tower on Puente Peak in the Puente Hills, according to Jeff Bentley, an FCC Broadcast Bureau attorney. Bob Moffett, director of engineering at KOCE-TV con-fumed that his station had agreed about five weeks ago to allow KGOF to propose switching to the KOCE-TV tower in its FCC application for a permit extensioa But, Moffett said, no agreement has been reached between the two. There's a pretty long laundry list of conditions that they would have to meet to satisfy us," Moffett said.

KOCE-TV is owned and operated by Golden West College in Huntington Beach. Moffett said the conditions involved safeguards to insure that KOCEs signal didnt suffer because of the sharing. He noted that many stations share tower and transmitter sites on ML Wilson, northeast of Los Angeles. Beh Golden Orange applied for an 18-month extension. FCC rules permit only a six-month extension.

He said a letter notifying Golden Orange of the extension is being prepared. If the station still is not on the air in another six months, it may apply for an additional extension, Bentley said. Although there is no legal limit to the number of exten-, sions which can be granted, Bentley said, "there Is a limit to the commission's patience." NBC Cancels Emmy Show, Cites Boycott BY LEE MARGULIES Timet Staff Writer NBC-TV canceled plans Friday to broadcast presentation of the television industry's 29th annual Emmy Awards for nighttime programs because, the network said, a boycott by actors and producers made it impossible to put on a quality show. After postponing the original May 15 telecast date last week, NBC had given the National Academy of Television Arts and Sciences a deadline of Friday to come up with assurances that it could present an Emmy show similar to those of past years, as its contract requires. "We have received no such information "Robert T.

Howard, president of NBC-TV, said Friday in a letter to Richard Rector, chairman of the academy." Therefore, we regretfully notify you that we are canceling the broadcast Howard said that' 200 performers had failed to enter themselves to be considered for Emmy nominations and that producers of many series had withdrawn their shows from competition. "Where so many shows and performers are not even be ing considered, it is impossible to represent that the awards are based on an industrywide competition The use of the name Emmy Award in a program and in publicity or advertising to describe a different type of award would be to the public, would not satisfy our contract, and would prejudice NBC drastically," Howard said. "I As' for the possibility of the academy trying to gel another network to televise the Emmys, Howard said it was NBC's position that the academy is "precluded from ar ranging for a nighttime telecast with anyone other than NBC unless NBC agrees to permit such arrangement The boycott of this year's Emmy Awards was launched last year by Hollywood-based members of the academy who felt that the organization was too broad-based and ought to be restricted to persons involved in national program production. Academy officials were not immediately available -for comment on NBC's decision. Rector had said earlier Friday, however, that the academy planned to award iti Emmys even if the ceremonies are not telecast.

Nominations will be announced on Wednesday, he said. NBC said it still intends to broadcast the academy's Emmy Awards show for daytime programs on May 12.
