Lyon Street, Santa Ana, Ualltomia (714) 547-6796 Six Realty Firms, 3 Men Convicted BALTIMORE P)-Six Washington area real estate firms and three of their officers have been convicted of conspiring to fix commission rates in the first government case against realtors under the criminal provisions of the Sherman Antitrust Act. The defendants were convicted by a U.S.

District Court Jury Wednesday for conspiring to raise commission rates from 6 to 7 in 1974. The three individuals could receive prison sentences of up to three years, and fines of $50,000 each. The companies involved could be fined up to $1 million. Sentencing is scheduled for Oct. 28.

At the trial, the government alleged that the conspiracy affected commissions on at least $350 million worth of Montgomery County real estate between 1974 and last April 1, when the indictments were returned. Prosecutors said the conspiracy took place at a Sept. 5, 1974, dinner arranged by John P. Foley, president of Foley Realty Co. The government said Foley informed the others at the dinner that he planned to raise his commission and the others agreed to do likewise.

Prosecution witnesses presented "a picture of these companies telling each other what they were going to do, and doing it," according to prosecutor Charles S. Stark. Defense lawyers, however, argued that the government's case was a "misinterpretation of the facts." Their witnesses said the decisions to raise commissions had been made independently, and were motivated by prevailing bad business conditions. Judge O. Stanley Blair told the jurors that a discussion about raising rates would not be a crime, but an agreement would constitute a conspiracy.

In addition to Foley and his firm, other defendants included: Bogley of Gaithersburg, and its president, Robert W. Lebling. Colquitt-Carruthers of Potomac, and its president, John T. Carruthers Jr. Schick Pepe Realty which has five Montgomery County offices.
