The attorney general hesitated, smiled and said: That's a very interesting question." But he declined to be specific about the investigation into allegations of assassination plots. Levi said he also believed himself obligated to publicly explain his position if there was "an extremely close question" and the department decided against prosecution. Levi voiced sharp disagreement with a Rockefeller commission recommendation that the Justice Department, in deciding whether to prosecute CIA employes, should confer with CIA officials and consider the impact of such prosecutions on national security. Mr. Ford said at the time, however, that he was turning over materials from the Rockefeller investigation to the attorney general to determine whether action should be undertaken against any individuals. If the department determines that there are grounds for state prosecution, Levi will turn the evidence over to the appropriate state authorities, he said. Levi indicated that state law could come into play if there was evidence that assassination plots had been discussed in the United States outside the District of Columbia.

The memo showed that the agreement had been worked out by Lawrence R. Houston, then CIA general counsel, and William P. Rogers, then deputy attorney general Rogers later became secretary of state in the Nixon administration.

The purpose of the agreement, abandoned by the CIA last January, was to prevent public prosecution of CIA agents that might reveal the agency's secret sources and techniques. In other developments. columnM Jack Anderson said that underworld figure Johnny Rosselli had told him he had been recruited to work on CIA assassination plans by Robert A. Maheu, a former aide to billionaire Howard Hughes. Rosselli, who testified in secret Tuesday to the Senate Select Committee on Intelligence Activities, said that Maheu had recruited him in 1960 in Los Angeles and later delivered poison pellets to him in Miami, Anderson said.

In a television interview, the columnist said Rosselli had revealed parts of his testimony to him. Rosselli said the poison pellets represented the first of six unsuccessful attempts to kill Cuban Premier Fidel Castro, Anderson said. BY ROBERT L. JACKSON TifitM Stff Writer WASHINGTON The head of the Central Intelligence Agency said Wednesday that the OA had gathered files on 75 congressmen. 71 more than he had reported last Jan-uary.

In his first public testimony since the Rockefeller commission report was made public June 10, CIA Director William E. Colby said that the additional congressional files were not strictly intelligence dossiers. That was the reason that he had not mentioned them earlier, he said. Colby told a House government operations subcommittee that all but four of the files he had referred to earlier were on congressmen who had undergone security clearances, had once assisted the CIA in some way or were former employes. But under questioning by Rep.

Bella S. Abzug the subcommittee chairman, and Rep. John Conyers Jr. Colby acknowledged that many of these files contained data on congressmen's travels abroad, particularly when a foreign group in which the CIA was interested had been contacted. FBI reports and news clippings referring to a congressman's presence at activities that included antiwar rallies also were found in the files.

Colby said. "We have supplied about 30 members of Congress with copies of their files, at their request." he said. Defending data collection on congressmen, Colby said that politicians were "neither a target nor immune" if their activities abroad coincided with a legitimate CIA interest, such as attendance at a scientific conference in a Communist country. However, the agency has halted all domestic intelligence gathering on U.S. citizens, he said.

Referring to the congressional files, Conyers told Colby: "Your explanation is quite unsatisfactory from my point of view."
